(631) 765-1809 · Fax (631) 765-9064 I EC IVED FINDINGS, DELIBERATIONS AND DETERMINATION ~ MEETING OF MAY 3, 2012 ZBA FILE: 6541 NAME OF APPLICANT: De Art of Nature, LLC PROPERTY LOCATION: 23423 Middle Road (CR 48) Cutchogue, NY SCTM# 1000-84-1-10.4 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 24, 2012 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: Subject parcel contains 256,307 sq. ft. and is located in an AC zone. It is improved with seven greenhouses, office trailer and farm stand. It has 257.90 feet of frontage on Middle Road (CR 48), 1143.65 feet along the easterly property line, 242.04 feet along the northern property line and 1018.85 feet on the westerly property line as shown on the site plan dated 12-15-11 prepared by Garrett A. Strang, Architect. BASIS OF APPLICATION: Request for Variances from Article III Code Sections 280-13A(2), based on an application for building permit and the Building Inspector's December 29, 2011 Notice of Disapproval concerning proposed additions/alterations to existing greenhouse structure and new office trailers, at; 1) less than the code required front yard setback of 60 feet, 2) less than the code required minimum side yard setback of 20 feet, 3) more than the code permitted maximum lot coverage of 20%. RELIEF REQUESTED: The applicant requests variances to construct additions/alterations to the main greenhouse and add a new office trailer, with front yard setback of 11.6 feet where the code requires 60 feet, a single side yard setback of 15.8 feet where the code requires 20 feet and lot coverage of 28.8% where the code permits 20% maximum lot coverage. ADDITIONAL INFORMATION: The Zoning Board requested comments from the Southold Town Planning Board. In a memo dated February 28, 2012, the Planning Board stated that the proposal is consistent with the goals of supporting and maintaining agriculture. Furthermore, the Planning Board supports the application with the condition that the fire district finds the narrowed side yard sufficient for emergency access to the residential properties to the north that use the shared R.O.W.. During the hearing, several neighbors expressed their concerns about ingress and egress on the R.O.W. from their adjoining properties to CR. 48. The applicant stated that all loading and unloading of vehicles will be done to the front and rear of the proposed greenhouse additions and that Page 2 of 3 - May 5, 2012 ZBA File#6541 - De Art of Nature, LLC CTM; 1000-84-1-104 they will present a letter to be agreed upon and signed by all parties stating the ROW will be widened at their expense for the length of the proposed greenhouse addition paralleling the R.O.W. and that the R.O.W. will be kept unobstructed at all times. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5, 2012 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b){1). Gram of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Agricultural operations have been in existence on this property for more than 20 years without any negative impacts. The Right of Way shall be improved and allow for unobstructed access to the adjoining properties to the north. The properties to the east and west are both agricultural and the proposed greenhouse additions on the subject property are in keeping with the character of these adjoining agricultural operations. 2. Town Law l~267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The main greenhouse is a 179'X 207' glass building. The proposed perimeter additions to all four sides of the existing greenhouse building are necessary to enable the applicant to move his specialty crops to a different solar orientation throughout the seasons as required by best management practices for growing his specific produce. 3. Town Law l~267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 81% relief from the code for the front yard setback and 44% for the lot coverage. However, the property has two front yards (CR 48 and a R.O.W.) and the right of way is only used by the applicant and two residential homes to the north. The proposed lot coverage is due to the number/size of greenhouse structures needed to sustain this agricultural business, since all crops must be grown under glass to meet the industry's food safely standards. The requested side yard setback variance is also substantial representing a 21% relief from the code. However, the proposed side yard widens along the building length so that only about 53% of the proposed side yard setback is non-conforming, 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. All storm water runoff will be retained on site. The right of way will be improved for easier and safer emergency access. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purehase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an improved greenhouse and organic farm operation while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member Goehringer, and duly carried, to GRANT, the variances as applied for, and shown on the site plan dated 12-15-11 prepared by Garrett A. The applicant shall submit a letter of agreement regarding the widening of the right of way access signed by all property owners that have legal access over said shared R.O.W. 2. The variances granted herein are subject to the completion of site plan approval by the Planning Board. 3. The shared R.O.W. shall remain open and unobstructed at all times. That the above conditions be wrilten into the BuiMing Inspector's Certificate of Occupancy, when issued Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks' and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de mintmis in nature for an alteration that does not increase the degree of nonconformity.
