THIS DECLARATION, made the 7~day'of December,
1983, by Charles B. Horow~tz, residing at 14 Dovas Path,
Southampton, New York, hereinafter referred to as the
Declarant.

WHEREAS, the Declarant is the owner of certain
real property situate at Orient, Town of Southold, Suffolk
County, New York, more particularly shown and designated as
Lots 2, 3, 4, 8 and 9 on a certain map entitled "Subdivision
Map of Settlers at Oysterponds", at Orient, Town of Southold,
Suffolk County, prepared by Young and Young Land Surveyors
on August 3, 1983, which is to be filed in the Office of the
Clerk of the County of Suffolk, and
WHERE~ , the Declarant is desirous of creating
an easement over the parcel of land described in Schedule A
attached heEeto ~or the benefit of any subsequent owner of
each of the aforementioned lots.
NOW, THEREFORE, the Declarant hereby grants
subsequent owners
right-of-way over
to any
of each of the aforementioned lots a common

for ingress

Narrow River Road and an easement for the installation of

to as the Declarant
WHEREAS, the Declarant is the owner of certain real property situate at
Orient, To,an of Southold, Suffolk Coua~ty, New York, more particularly shown
and designated on a certain map entitled "Sulx~ivision Map of Settlers at Oys-
terponds", at Orient, Tow~] of Southold, Suffolk Cotnnty, prepared by Young and
Yoang Land Sufveyors on August 3, 1983, which is to k~ filed in the Office of
the Clerk of S'dffolk County, and
WHEREAS, the Declarant has made application to the Planmning Roard of the
~bwn of Soutbold for approval to sukx~ivide the said real property into 10 par-
cels, shown and designated on Suk~ivision Map entitled "settlers at Oyster-
ponds", annexed hereto, and
WHEREAS, for and in consideration of the granting of said approval, the
Plarnning Board of the Tom of Southold has deemed it to be for the k~st inter-
ests of the Town of Seuthold and the owners and prospective owners of said par-
cels that the within covenant ~ imposed on said parcels, and as a condition of
said approval said Planning Board has required that the within Declaration ~
recorded in the Suffolk County Clerk's f~ffice, and
WHEREAS, the Declarant has considered th6 foregoing and determined that
the same will t~e for the ~st interests of the Declarant and subsequent o~ers
of said parcels,
NOW, THEREI.XDRE, THIS DECLARATION WIqT~ESSETH:

said premises herein designated shall hereafter be subject to the following
