This portion of the project should be exempt from waterfront consistency renew as a"minor action"(Chapter 268-3(B)). However,a return will also be added to the easterly end of the wall to protect the parcel from erosion being created by the slumping embankment on the property to the east. Without replacement of this wall,the subject embankment would also be allowed to slough and in turn compromise the slope behind the wall to the west. As part of the project, the portion of the subject slope disturbed during construction will be revegetated and maintained as a nonturf buffer upon project completion. Therefore, it is necessary to replace the wall, and doing so will have no significant adverse impacts on the adjacent beach or tidal waters of Great Peconic Bay and will be consistent with Policy 4.
