PROPERTY LOCATION: 80 Glenn Road (Main Bayview Road) (adj. to West Creek) Southold, NY
SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type Il category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated November 16, 2011 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency
review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. The LWRP Coordinator issued a recommendation dated November 29, 2011. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to us, it is our recommendation that the proposed action is INCONSISTENT with LWRP policy
standards and therefore is INCONSISTENT with the LWRP.
PROPERTY FACTS/DESCRIPTION.. Subject parcel contains 35,503 sq. fi. and is improved with a one and a half
story framed dwelling with attached garage. It has 182.26 feet of frontage on Main Bayview Road, 180.39 feet of
frontage on Glenn Road, 200.12 feet along the eastern property line and 206.o6 feet along the southern property
line. The south east comer is adjacent to West Creek as shown on the survey dated November 9, 2004, revised per
ZBA comments on December 28,2011 prepared by Nathan Taft Corwin, Ill, Land Surveyor.
BASIS OF APPLICATION: Request for Variance from Article III and Article XXII, Code Section 280-15, 280-
15F and 280-116B and the Building Inspector's October 3, 2011, Amended December 22, 2011, Notice of
Disapproval based on a building permit application to constmnt an accessory garage, at: 1) more than the code
required maximum square footage of 750 sq. ft. on lots 20,000-60,000 sq. fi., 2) less than the code required
principal front yard setback on a waterfront parcel of 40 feet,, 3) less than the code required bulkhead setback of 75
feet.
RELIEF REQUESTED: The applicant requests variances to construct an accasso~y two-car garage located in the
front and partially in the side yards, where the code requires a rear yard location, or in the case of a water front
parcel a front yard location is permitted provided it meets the principal setback for the zone. The proposed garage
is located 33 feet from the front yard setback where 40 feet is required by code. Additionally, applicant is
ZBA File#6522. Briamnn
requesting an 864 sq. ft. garage where the maximum allowed by code is 750 sq. fo. and a bulkhead setback of 56
feet where the code requires 75 feet.
AMENDED APPLICATION: The original application was for one variance request for an accessory garage larger
than allowed by code. During the first hearing, the applicant stated he applied to New York State DEC and thc
agency was asking him to relocate the garage closer towards the front property line of Main Bayview Road away
from the wetlands. The applicant submitted revised plans, which required a new Notice of Disapproval from the
building department.
ADDITIONAL INFORMATION: The new Notice of Disapproval, revealed that the applicant required three
variances; accessory garage total square footage, front yard setback and bulkhead setback. In a memo dated
January 3, 2012, the LWRP Coordinator noted that the applicant's revised plan shows he has integrated best
management practices to further the policies of the LWRP to the greatest extent practicable and therefore the Board
may want to consider issuing a consistent determination. The applicant submitted the NYS DEC permit and
approved survey.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held public hearings on this application on December 1,2011, January 5, 2012 and
February 2, 2012. Based upon all testimony, documentation, personal inspection of the property and surrounding
neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the
following findings:
1. Town Law $267-b(3)(b)(l). Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. Accessory garages are common in this area. The applicant
will screen the garage from the road with evergreen plantings.
2. Town Law §267-b(3](b)(2), The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. The subject property contains two front yards and is
located on the waterfront, so the placement of an accessory structure in a conforming location is limited. The
proposed 864 sq. ft. accessory garage is a pre-engineered kit that is assembled on site and cannot be altered in size,
and the applicant stated it is the smallest structure that is useable to meet his needs for the storage of his boat and
other equipment.
3. Town Law l~267-193)(b)(3). The variances granted herein are mathematically substantial. The proposed size of
the accessory garage represents a 15 % variance; the proposed front yard setback represents a 17,5% variance; and
the proposed bulkhead setback a 27% variance from the code. However, these variances are mitigated by the
constraints of two front yards and water frontage on the subject property.
4. Town Law §267-b(3}(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant has integrated best management practices to further the policies of the LWRP to the greatest extent
practicable and reduced impact. Additionally, the new location mitigates the proximity to the wetlands as requested
by New York State DEC.
5. Town Law §267-b(3)(b)(S}. The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6, Town Law ~267-b, Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.

RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Weisman (Chairperson), seconded by Member
Schneider, and duly carried, to
GRANT, the variance as applied for, and shown on the survey prepared by Nathan TaR Corwin, III, Land
Surveyor dated November 9, 2004 last revised December 28, 2011 and architectural drawings prepared by Barn
Pros pages 1-8 and dated 10/30/11, expired 4/17/12.
CONDITIONS:
1. Existing trees to be retained to the greatest extent practicable.
2. A 75 foot long evergreen berm along Main Bayview, shall be planted and continuously maintained, as
shown on the survey prepared by Nathan Taft Corwin, III, Land Surveyor dated November 9, 2004 last
revised December 28, 201 l.
That the above conditions be written into the BuiMing Inspector's Certificate of Occupancy, when issued.
.4ny deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a passible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other.features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.

The Department of Environmental Conservation (DEC) has reviewed your request to modify the
above referenced permit in accordance with the Uniform Procedures Regulations (6NYCRR Part 621). It
has been determined that the proposed modifications will not substantially change the scape of the
permitted actions or the existing permit conditions. Therefore, the permit is hereby modified to

TERMS AND CONDITIONS
The Permittee Joseph & Elizabeth Brittman, residing at 80 Glenn Road, Southold, New York
as part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if futura operations of the Town of Southold require the removal and/or alterations in
the location of the work heroin authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Pcmfittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction
to the deed of the subject parcel. Such evidence shall be provided within ninety (90)
calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.

supplemental to this permit, which may be subject to revoke upon failure to obtain same.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 21, 2012 regarding the above matter:
WHEREAS, JOSEPH & ELIZABETH BRITTMAN applied to the Southold Town
Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated November 9, 2011,
and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policY standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 21,2012, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of JOSEPH &
ELIZABETH BRITTMAN to construct a 24'x36' detached barn/garage; with the
condition that a 15' wide non-turf buffer is to be installed and maintained along the
landward edge of the wetlands; and as depicted on the survey prepared by Nathan Taft

NATURAL RESOURCE PERMIT CONDITIONS - Apply to the Following
Permits: TIDAL WETLANDS
1. Conformance With Plans All activities authorized by this p~mdt must bc in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.
Such approved plans were prepared by Nathan Taft Corwin III, last revised on 12/28/11.
1. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee
and contractor shall sign and return the top portion of the enclosed notification form certifying that they
are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion
of project, the bottom portion of the form must also be signed and returned, along with photographs of
the completed work.
3. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.
4. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the permitted activities.
5. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from
construction of this project shall be completely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is p~mdtted in wetlands and/or protected buffer areas.
6. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to
escape into any wetlands or waters of New York State, nor shall washings from ready-mixed concrete
trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or
waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms.
7. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined within the project work area and/or upland areas greater than 50 linear feet from the tidal
wetland boundary.
s. Runoff Directed to Upland Drywells Roof runoff shall be directed to drywells a minimum of 75
linear feet landward of the tidal wetland boundary for mediate on-site recharge.

9. Establish Vegetated Buffer To protect the values of the tidal wetlands, a permanent vegetated
buffer zone shall be established. There shall be no disturbance to the natural vegetation or topography
within an area extending 15 linear feet landward of the tidal wetland boundary.
10. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be
stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior
to pemtit expiration, whichever comes first. If the project site remains inactive for more than 48 hours
or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or
jute matting until weather conditions favor gcmiination.
11.. Tidal Wetland Covenant The permittee shall incorporate the attached Covenant (or similar
Department-approved language) to the deed for the property where the project will be conducted and file
it with the Clerk of SUFFOLK County within 30 days of the effective date of this permit. This deed
covenant shall mn with the land into perpetuity. A copy of the covenanted deed or other acceptable
proof of record, along with the number assigned to this permit, shall be submitted within 90 days of the
effective date of this permit to

12. State Not Liable for Damage The State of New York shall in no case be liable for any damage or
injury to the structure or work herein authorized which may be caused by or result from future operations
undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no
claim or right to compensation shall accrue from any such damage.
13. State May Order Removal or Alteration of Work If future operations by the State of New York
require an alteration in the position of the structure or Work herein authorized, or if, in the opinion of the
Depaxtment of Environmental Conservation it shall cause unreasonable obstruction to the free navigation
of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause
loss or destruction of the natural resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State,
and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized' shall not be completed, the owners, shall, without
expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require, remove all or any portion' of the uncompleted structure or fill
and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall
be made against the State of New York on account of any such removal or alteration.
14. State May Require Site Restoration ffupon the expiration or revocation of this permit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Department of Environmental Conservation may
lawfully require, remove all or any portion of the uncompleted structure or fill and restore the site to its
former condition. No claim shall be made against the State of New York on account of any such
removal or alteration.

15. Precautions Against Contamination of Waters All necessary precautions shall be taken to
preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents,
lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials
associated with the project.
GENERAL CONDITIONS - Apply to ALL Authorized Permits:
1. Facility Inspection by The Department The pcmfitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Department
of Environmental Conservation (the Department) to det~m~ne whether the permittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301
and SAPA 401(3).
The permittee shall provide a person to accompany the Depa~hnent's representative during an inspection
to the permit area when requested bythe Depattment.
A copy oft/tis permit, including all referenced maps, drawings and special conditions, must be available
for inspection by the Department at all times at the project site or facility. Failure to produce a copy of
the pomait upon request by a Depattment representative is a violation of this peamit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Depas tment, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Depaxhuent or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The l~mdttee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
l~tait. Such application must include any forms or supplemental information the Depadment requires.

JOSEPH & ELIZABETH BRITTMAN request a Wetland Permit to construct a 24'X 36' detached
barn/garage. Located: 80 Glenn Rd., Southold. SCTM#78-2-11.3
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Dear Mr. Walker,
Thank you for the informative, candid dialogue today in review of our
application #1-4738-01877/00010.
As we discussed:
1) Due to our property being a corner lot we are restricted to 40' front
yard setbacks by the Town of Southold. Therefore when the garage was
designed, to maintain the 40' setback it resulted in the back edge of the
proposed structure being 45' from the tidal wetland edge. As you can
see on the property survey, our home has several points that are 50'
from the wetland edge. We will make every effort to pursue a 33' front
yard setback variance from the Town of Southold. It is our hope that the
additional 7' for a total of 52' from the wetland edge will be acceptable
to the DEC. This change in setback from the street will then be
consistent with the 33' setback facing Glenn Road
(#1-4738-01877/00005).
2) The proposed dry well was based on a two inch rainfall calculation put
together by our surveyor. We are willing to install an additional drywell
if the DEC determines this would be beneficial.
3) The work related to #1-4738-01877/00007 has been completed and
there is a 15' non turf buffer in place comprised of beach grasses. Please
see the included photographs. We have decided not to install the
seasonal ramp/float.
4) Please note that our surveyor is updating the survey to reflect the 15'
non turf buffer, the tidal wetland boundary, the additional drywell and
the new proposed location of the structure.
5) Again, as discussed today regarding the steps and balcony area. The
landing and balcony above are 50sf. While the proposed plan and prior
photographs suggest an area larger, this larger footprint of 113sf also
includes the steps which were required by the Town of Southold. The
steps are permeable with 3/8" spacing between unfinished boards (no
paint). The steps are not on footings or foundation.
Our history as waterfront homeowners reflects our commitment to the
environment and local flavor of our town. We have given careful
consideration as to the size of our garage, its location placement on the
property, its barn style construction and accompanying plantings and
vegetation.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard ,4rea.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluat~ as to its significant
