Dear Mr. Warlan:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 21, 2012 regarding the above matter:
WHEREAS, Michael Warlan on behalf of BEIXEDON ESTATES ASSOCIATION, INC.
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated September 9, 2011, and revised on February 27, 2012, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program CoordinatOr for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation {hat the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 21, 2012, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of BEIXEDON
ESTAES ASSOCIATION, INC. to remove and replace 37' of damaged bulkhead using
vinyl sheathing and 2' higher than existing; construct a 30' retum on the east side; install
rip-rap ¼ to 1 ton stone armor in front of bulkhead; replenish beach with approximately
400 cubic yards of sand; and construct 4'x12' beach stairs; and as depicted on the
survey prepared by Nathan Taft Corwin III, last dated October 25, 2011, and stamped
approved on Mamh 21, 2012.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

2012 the following recommendation was made:

not mediate the current problem. The CAC recommends an appropriate slope rock
revetment with native vegetation. T

Dear Town Trustees:
Beixedon Estates Association, Inc. has submitted an application for replacing the Hurricane Irene
damaged 37 foot community bulkhead with a 30 foot return and 4' x 12' stairs. We are requesting a 2
foot increase in height above the existing bulkhead to prevent storm wave surge from breaching the
bulkhead.
We am also requesting that the amendments to permit ~69B to install rip-rap ~ to 1 ton stone armor
in front of the existing bulkhead, as depicted on the survey prepared by Nathan Taft Corwin III dated
May 14, 2010 and to replenish the beach with approx. 400 cy. of sand, as depicted on the site plan
prepared by Dru Associates, Inc. last revised April 16, 2011 be included in this applicat on.

to remove and replace 40' of existing bulkhead using vinyl sheathing and 1' higher than
existing; construct a 30' return on the east side; and construct 4'X 8' beach stairs. Located:

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is CONSISTENT with the LWRP review provided
the following best management practices are required if the action is approved:
To further Poficy 5: Protect and Improve Water Quality in the Town of Southold and Poficy 6;
Protect and Restore the Quality and Function of the Town of Southold Ecosystem it is
recommended that the Board require a silt boom during construction.
§ 275-11. Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of
the Trustees:

Beixedon Estates Association, Inc. has submitted an application for replacing our commLinity bulkhead
because of the damage incurred from Hurricane Irene on August 28, 2011. After several years of effort,
we recently obtained amendments to our DEC permit and Trustees permit ~469B for rip~ rap and sand
replenishment. The Town Trustees permit for sand replenishment was issued on July 20, 2011. The
Beixedon Estates community requested that the work for the sand replenishment and rip- rap project
start after Labor Day to avoid disrupting the beach during the summer. Unfortunately, the damage from
Hurricane Irene happened before we were able to start this project.
We are requesting that the amendments to permit ~t469B to install rip-rap ~ to I ton stone armor in
front of the existing bulkhead, as depicted on the survey prepared by Nathan Taft Corwin III dated May
14, 2010 and to replenish the beach with approx. 400 cy. of sand, as depicted on the site plan prepared
by Dru Associates, Inc. last revised April 16, 2011 be included in this application.
