The proposed patio, brick or stone in sand, measures 6.0' x 24' from the back edge of the addition and is 186.18 sq. ft. of additional patio area. This additional patio area is landward of the approved changes to the residence and 96' landward edge of the wetlands, 7.0 feet landward of the approved deck to patio on grade, in sand. Our current site plan reflects previously approved changes to the seaward, freestanding, permitted patio in the lawn. (by the tree) The building department will not allow us to proceed with revisions to their permit without your review and hopefully an administrative determination that this request for this amendment to the plans, meets with your approval. They waited until after we had applied to you for the permits, that you have since granted,to confirm that they had decided to build the garage. In the process of reviewing the project with the building department it was further determined that the area of the second floor on the east end of the home currently used as a bedroom, does not meet code as habitable space due to lack of head room so a small dormer is also proposed to bring this to code. The only change to the footprint is landward of the approved changes to the residence and over 100' from the riprap or landward edge of the wetlands... The waterside dormer is landward of the edge of the existing home's seaward deck by over 20'. The building department will not allow us to proceed with revisions to their permit without your review and hopefully an administrative determination that this request for amendments to the plans, meet with your approval. This platform had been installed long before we owned the property, and appears on a number of prior surveys and documents. Following the hurricane, we intended to simply place the platform back where it had been, but then realized that the frame and some of the boards had been damaged as it was washed up onto the lawn. We salvaged some portions and replaced damaged portions, and returned the platform to the place it had occupied for years. At the time, the NYS DEC had announced that it was waiving permits for homeowners to repair storm damage to their property, in order to facilitate quick repairs. I proceeded in reliance on this waiver. It appears that I overlooked an additional permit requirement with the town or Trustees of Southold, and I would appreciate your conveying my sincere apology --my goal was to clean up the damage from the storm as quickly as possible, and not to disregard their rules.
