PROPERTY FACTS/DESCRIPTION: The Applicant's property is a 45,983 sq. ft. waterfront parcel in the R-40 Zone. The northerly lot line measures 143.86 feet along Broadwaters Cove. The easterly lot line measures 332.65 feet along Nassau Point Causeway and Nassau Point Road. The southerly lot line measures 111.64 along adjacent residential property, and the westerly lot line measures 281.76 feet along another residential property. The parcel is improved with a single-family dwelling, the garage subject of this application, and a shed, as shown of the survey drawn by Peconic Surveyors, dated June 10, 2011. BASIS OF APPLICATION: Request for Variance from original ZBA #6504 and the Building Inspector's February 7, 2012 Notice of Disapproval based on amended plans for the accessory garage at; 1) the demolition and reconstruction are a deviation of the original ZBA grant allowing additions and alterations. RELIEF REQUESTED: The applicant requests a variance to demolish and reconstruct, with alterations, an accessory garage, with a nonconforming 3.6 feet side yard setback at 76% relief from Code required 15 feet side yard setback, and construction of a second floor window dormer covering 84% of the roof area, which is a 110% relief from the Code permitted 40% of roof/window dormer area. ADDITIONAL INFORMATION: The Applicant originally filed ZBA Application #6504 On July 27, 2011, requesting three variances to construct alterations to an existing nonconforming accessory garage. The Applicant stated at the Oct. 6, 2011 Public Hearing that it would be a hardship to relocate the garage to a more conforming location on the property, and that they would utilize the existing building foot print and foundation, and maintain the existing non-conforming 3.6 feet side yard setback. The variances were granted as applied for, including a variance to increase the degree of nonconformity of an existing nonconforming building, a variance to maintain a 3.6 feet side yard setback, and a variance for the addition of a non-conforming second floor window dormer involving 84% of roof area, which is 110% relief from Code permitted area for roof dormers of 40%. During the construction/alteration project the Applicant's contractor effectively demolished the accessory garage, and because this work was beyond the scope of the variances granted, a new application was submitted for the demolition/reconstruction. Page 2 of 3 - April 19, 2012 ZBA File#6551 - Seiferth FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 5, 2012, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Applicant did have a garage at this nonconforming location prior to the demolition. No evidence has been presented to indicate that the location has caused a detriment to nearby properties. A garage did exist at this location since before Town wide zoning was in effect, and that garage did have a valid pre-CO until that building was recently demolished. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant or cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The Applicant has stated that it would not be feasible to relocate the garage to a conforming location on the property. The Applicant also stated that a variance for the dormer construction is the only feasible method for the Applicant to make additional headroom on the second floor to effectively utilize the space for storage. 3. Town Law §267-b(3)(b}{3). The variances granted herein are mathematically substantial, representing 76% relief from the Code for the nonconforming 3.6 feet side yard setback, and is 110% relief from the Code allowed 40% dormer area. However, the variances are mitigated by the fact that although the pre-CO was forfeited because of the process of building demolition, a garage had existed at this exact location since prior to Town Zoning. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The newly constructed garage will have roof gutters and leaders to contain runoff as required by Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 1~267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new accessory garage where one once existed, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Goehringer, and duly carried, to GRANT, the variance as applied for, and shown on the Architectural drawings entitled "Seiferth Residence- Proposed Garage Renovation" pages 1-6, dated 1.31.2012 and prepared by Nancy Dwyer, Design Consulting, Inc., professionally stamped by James J. Deerkoski, P.E., subject to the following conditions: CONDITIONS: 1. The accessory garage shall be used for storage only, and not be utilized for cooking, sleeping, or any livable space. 2. The accessory garage shall only contain basic electric service and an outside hose bib. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the rightto substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated August 2, 2011 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his reply dated September 26, 2011. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review for the setback variance request and the proposed dormer at more than 40% is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The subject property is improved with a single family dwelling, a framed accessory building and a one and a half story framed accessory garage. It contains 45,983 sq. fi. and has 150.29 feet on Nassau Point Rd., 182.36 feet on the east property line, 143.86 feet on Broadwaters Cove, 281.76 on the west property line and I 11.64 feet on the south property llne as shown on the survey prepared by Peconlc Surveyors dated June 10, 2011. BASIS OF APPLICATION: Request for Variance from Article XXIII Code Section 280-122, and Article Ill Code Section 280-15 and the Building Inspector's June 2, 2011 Notice of Disapproval based on an application for building permit for additions/alterations to a non-conforming accessory garage at; 1) a nonconforming building containing a conforming use may be enlarged as long as the action does not create any new nonconformance or increase of nonconformance with regard to the regulations pertaining to such buildings, 2) less than the code required side yard setback of 15 feet, 3) second floor roof dormers at more than the code required 40% of the roof width. RELIEF REQUESTED: The applicant proposes to maintain the existing nonconforming 3.6 foot side yard setback, of the existing nonconforming garage, which will require an 11.4 foot variance relief from the Code required 15 feet. The applicant also proposes to dormer the area ~twcen two existing "dog house" dormers, creating one dormer, which would create a dormer of 84% of the roof width and require a 110% relief of the Code permitted 40%. The footprint of the existing garage is proposed to remain the same and there was no evidence submitted to imply that the subject garage will be used as a dwelling. The applicant testified at the public hearing that he intends to use the subject structure as an unheated, seasonal recreation and sitting space for family use. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 6, 2001, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law ~267-b(3)(b)(l}. Granting of the requested variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. No evidence has been presented to indicate that the location of the existing nonconforming garage has caused a detriment to nearby properties. The garage has existed in its current location since prior to zoning of 1957 and has a pre-CO. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than the area variances. It would not be feasible to relocate the subject garage to a conforming side yard setback. The requested relief of the dormer variance is the only method available for the applicant to pursue in order to acquire additional headroom height on the second floor. 3. Town Law $267-b¢3)(b)(31. The variance granted herein for the side yard setback relief of 11.4 feet or 76% is mathematically substantial, however the substantiality is mitigated when considering the subject garage exists in its present location. The variance granted herein for the donner relief of 110 % is mathematically substantial. The substantiality may be mitigated when considering the proposed donner will combine the existing "dog house" dormers. 4. Town Law $267-bf3~(bl(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The garage has existed in its current location since prior to 1957, and the renovated garage will incorporate gutters and leaders to control onsite roof runoff per code. 5. Town Law [i267-b(3)(b)(5). The difficulty has been self-created. The applicant acquired the parcel at'er the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use oftbe parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of renovating the existing nonconform lng garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
