lot area, width and depth of two parcels in this pending division located
on a private right-of-way extending off the north side of Main Road,
Orient, NY; County Tax Map District 1000, Section 14, Block 2, Lot 26,
containing 3.2 acres total.
WHEREAS, a public hearing was held and concluded on Apri~ 2, 1987
in the Matter of the Application of ANA G. STILLO under Appeal No. 3619;
and
WHEREAS, at said hearing all those who desired to be heard were
heard and their testimony recorded; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the board made the following findings of fact:
1. The premises in question is a described parcel of land con-
taining a total area of 3.2 acres which extends at the northerly end
of a private 20' right-of-way 300.43 feet from the northerly side of
the Main Road, Orient, Town of Southold, and is more particularly
designated on the Suffolk County Tax Maps as District lO00, Section
014, Block 2, Lot 26.
2. The entire premises is vacant.
3. This is an application requesting: (a) approval of the
proposed insufficient lot area and width of Lot #1 of 1.6 acres, (or
69696 sq. ft.) and 155 ft., respectively; (b) approval of the
proposed insufficient lot area and width of Lot #2 of 1.6 acres, (or
69696 sq. ft.) and average width of 153.50 ft.

4. Town records show that the subject 3.2-acre parcel was
conveyed to the applicant on July 20, 1983, Liber 9393 cp 136.
5. The amount of relief requested as to the total area of
each proposed parcel is .1288% of the requirements, or 10,304 sq.
ft., and as to lot width .1143% of the requirements, or 20± feet
of each proposed parcel.
6. It is noted for the record that: (a) by letter dated
March 12, 1987, the N.Y.S. Department of Environmental Conservation
waived jurisdiction; (b) the Suffolk County Department of Health
Services approved this division as revised March 9, 1987 and
October 21, 1986; (c) an application is pending before the
Southold Town Planning Board for a minor subdivision which has
not as of this date been finalized.
7. It is also noted for the record that: (a) the subject
premises received a conditional approval of access as rendered
under Appeal No. 3562 December 11, 1986 for Ana G. Stillo; and
as of this date, the necessary improvements for acceptance have
not been done; and (b) premises to the east consist of two minor
subdivisions finalized prior to the enactment of the 80,000 sq. ft.
minimum lot area requirement, to wit: the most northeasterly
five-lot subdivision (approved November 29, 1972, Frank Stillo),
and the southeasterly three-lot minor subdivision (approved
June 12, 1979, P. Sledjeski).
In considering this appeal, the board also finds and
determines: (a) the percentage of relief requested as amended
is not substantial, being a variance of approximately 12% of
the requirements; (b) the circumstances of the property are
unique; (c) there will not be a substantial change in the
character of the neighborhood; (d) the relief requested is
not unreasonable under the circumstances; (e) there is no other
method feasible for appellant to pursue other than the variances
requested; (f) in view of the manner in which the difficulties
arose and in considering all the above factors, the interests of
justice will be served by allowing the variance, as conditionally
noted below.
Accordingly, on motion by Mr. Sawicki, seconded by
Mr. Goehringer, it was
RESOLVED, to APPROVE the insufficient lot area and width
of proposed Parcels #1 and #2 of 69695 sq. ft. and 153.50± feet,
respectively, as applied in the Matter of the Application of
ANA G. STILLO under Appeal No. 3619, SUBJECT TO THE FOLLOWING
CONDITIONS:
1. No lot-line changes or adjustments as to lot area/width;
2. Conditions rendered under Appeal No. 3562 concerning
the pending 280-a status;
3. This variance is temporary for a maximum period of two
years, except where the pending division of land has been finalized
by all involved agencies and the parcels have been transferred by
deed or other legal document to reflect the subdivision lot lines
accordingly.

Dear Rudy and Pat:
This letter is in response to your August 4th inquiry
concerning 280-a status in the above matter.
The procedure to be followed in either requesting
a second, alternative 280-a~ or substituting another
private access, is only by formal application to the
Board of Appeals. The Board does not have authority to
change or modify, waiver, or take other action concerning
previous decision(s) without formal application, public
hearing, etc.
When applying for the new access route, please be
sure to furnish copies of the granted easement for
both parcels.

Dear Linda:
With regard to the conditions of the Z.B.A.'s April 2, 1987 resolution
to approve the above appeal application, we respectfully request that
the Board consider the removal of condition ~2 therefrom.
It is no longer our client's intention to utilize the subject right of
way to access this property. Alternative access (shown on the
enclosed copy of the subdivision plan) is available to service both
lots, rendering the subject access superfluous and the improvements to
same unneccessary.
Please advise as to the procedure you would recommend we follow in
order to obtain the Board's approval of this amendment to the above
mentioned 4/2/87 resolution.

Please let this confirm the following action taken by the
Southold Town Planning Board, Monday, June 15, 1987
RESOLVED that whereas, a formal application for the approval
of a subdivision plat entitled "Ana G. Stilld'located at
Orient, tax map no .1000-14-2-26 was submitted to the Planning
Board on April 20, 1987 and filing fee of $550 was also submitted
on April 20, 1987, and
WHEREAS, a public hearing was held on said subdivision application
and palt at the Town Hall, Southold, New York on Jun el,
1987 at 7:30 p.m, and
WHEREAS, the requirements of the Subdivision Regulations
of the Town of Southold have been met by said subdivsion
plat and application,
NOW, therefore, be it RESOLVED that the application of Ana
G. Stillo for approval of said subdivisino plat prepared
by Rod Van Tuyl, and last dated January 29, 1987, be approved
and the Chairman be authorized to endorse approval on said
subdivision plat, subject to the following conditions within
six months from the date of this resolution.
1. Receipt and compliance with the resolution of the
Suffolk County Planning Commission.
2. Notice of completion and approval of the access
road improvements as per the Board of Appeals decision of
April 2, 1987.

7:40 p.m. Appeal No. 3619 - Public Hearing commenced in the
Matter of ANA G. STILLO. Variances for approval of insuffi-
cient lot area, width and depth of two parcels in the pending
division. ROW off N/s Main Road, Orient.
The Chairman read the legal notice and application for the record.
CHAIRMAN GOEHRINGER: I have a copy of the survey most recent-
ly updated January 29, 1987 indicating lot numbe~ 1 at 1.6 acres,
lot number 2 at 1.6 acres. And I have a copy of the Suffolk
County Tax Map indicating this and surrounding prope.rties in the
area. Ms. Moore, you'd like to be heard again.
MS. MOORE: This Stillo application is the .s%cond time around
that you're seeing it. The first hearing was number 3562, Novem-
ber 20th. At that time, the Board made a recommendation that the
subdivision not be approved into a three lot minor subdivision.
We went back, we continued with the Health Department. We re-
ceived the Health Department approval. We do have no jurisdic-
tion determination by the D.E.C. and we went back to the Plan-
ning Board with a two lot subdivision. And they recently, which
I believe there should be a letter in your file, they made a recom-
mendation and approved it this time. So we're back before you and
I'd like to incorporate the arguments and all the exhibits from the
prior hearing. Not to continue this much more than needed to be.
And if you have any questions, I'm here to answer them.
CHAIRMAN GOEHRINGER: I believe this is the one we approved the
right-of-way but denied the subdivision.
MS. MOORE: Yes.
CHAIRMAN GOEHRINGER: Is there anybody else who would like to speak
in favor of this application? Anybody like to speak against the ap-

The proposal for two lots, although revised from the
previous three lot application, does not meet the current
two acre zoning and the Board cannot endorse it.

The following action was taken by the Southold Town Planning
Board, Monday, February 10, 1986.
RESOLVED that the Southold Town Planning Board refer the
following comments and recommendations regarding the subdivision
proposal for Ana G. Stillo, located at Orient:
The proposed zoning for this area is R-80 and the area
just South of this parcel is proposed for R-400 zoning.
The Board is not in favor of this subdivision and
recommends that it remain as one building lot, since the
~ ~posed subdivision is not in compliance with the existing
ok proposed zoning.

greater than 100' in length which was constructed prior to September 20, 1977.

natural slope.
~Landward of the topographic crest of a bluff, cliff or dune which is greater
than 10' in elevation above mean sea level.
Listed in Part 661.5 of 6NYCRR (Tidal Wetlands Land Use Regulations) as a use
not requiring a permit or notification letter approval.
Therefore, no permit is required under the Tidal Wetlands Act (Article 25 of the
Environmental Conservation Law). Please be advised, however, that no construction,
sedimentation or disturbance of any kind may take place seaward of the 10' contour or
topographic crest without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or other alteratlon or
disturbance to the ground surface or vegetation in this area as a result of your pro-
ject. Such precautions may include providing adequate work area between the 10' con-
tour or topographic crest and the project (i.e. a 15' to 20' wide construction area)
or erection of a temporary fence, barrier, or hay bale berm.
Please note that any additional work, or modification to the project as described,
may require authorization by this Department. Please contact this office if such
are contemplated.
Please be further advised that this letter does not relieve you of the responsibility
of obtaining any necessary permits or approvals from other agencies.

We enclose herewith a copy of your 4/24/86 letter of no jurisdiction,
with a copy of the survey referred to therein attached. This proposed
subdivision has been modified. Our client now proposes to divide the
3.2 acre parcel into two (2) lots rather than three (3) lots. (See
copy of R. Van Tuyl survey dated 1/29/87, enclosed herewith). In all
other respects the project remains the same.
Please verify for us that your determination of no jurisdiction is
still valid for this project as modified.
