This Indenture, made the Z,9/1,day of August, Nineteen Hundred and Ninety-Nine
Between HOWARD LOWELL BROWN and ELLA BROWN, residing at 3256 Mandeville Canyon Road, Los
Angeles, CA 90019,
party of the first part, and WILLIAM KUHL and RENA KUHL, residing at 69 Pine Street, Garden
City, NY 11530,
party of the second part,
Witnesseth, that the party of the first part, in consideration of Ten Dollars and other
valuable consideration paid by the party of the second part, does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk, State of New
York, said lot being more particularly bounded and described as follows:
EASTERLY PART OF PREMISES;
BEGINNING at a point on the southerly line of North Road to Bayview at the northeasterly
corner of land conveyed to the parties of the first part by deed dated April 25, 1972;
RUNNING THENCE along said line of North Road to Bayview, South 68 degrees 37 minutes 20
seconds East, 21.52 feet to the westerly line of a certain 30-foot right of way;
RUNNING THENCE along said westerly line South 00 degrees 16 minutes 21 seconds East, 275.00
feet more or less to ordinary high-water mark of Goose Creek;
RUNNING THENCE northwesterly along said high-water mark of Goose Creek 25.00 feet more or
less to said other land of the party of the first part;
RUNNING THENCE along said other land North 00 degrees 16 minutes 20 seconds West, 250.00 foot
more or less to the point or place of BEGINNING.
SUBJECT TO a water main easement across the northerly 5 feet of the premises.
WESTERLY PART OF PREMISES
BEGINNING at a point marked by an iron pipe on the southerly side of North Road to Bay View,
617.63 feet southerly and easterly along the westerly and said southerly side of said North
Road to Bay View from the southerly side of Oakwood Drive from said point of beginning;
RUNNING THENCE along said southerly side of North Road to Bay View South 68 degrees 37
minutes 20 seconds East, a distance of 100.00 feet;
THENCE along other land of Southold Development Corporation South 00 degrees 16 minutes 20
seconds East, a distance of 270 feet, more or less, to ordinary high-water mark of Goose
Creek;
RUNNING THENCE northwesterly along said high water mark a distance of 180 feet, more or less,
to a point which is South 09 degrees 22 minutes 40 seconds West, a distance of 180 feet, more
or less, from the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the grantors herein in deed dated
August 8, 1995, recorded on January 19, 196 in Liber 11758, cp 926.
Together with all right, title and interest, if any, of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
Together with the appurtenances and all the estate and rights of the party of the first part
in and to said premises; To Have and to Hold the premises herein granted unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in anv way whatever, except
as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law, covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the payment of, .
the cost of the improvement before using any part of the total of the same for any other
purpose.
