WITNESSETH, that the party of the first part, in consideration of Ten and 00/100--($10.00)--dollars, and other
good and valuable consideration paid by the party of the second part, does hereby grant and release unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being at Mattituck, in the Town of Southold, County of Suffolk and State of New
York, being bounded and described as follows:
BEGINNING at a point situate on the boundary line between land of Jazombek and land of Hallock
which point is situated the following two (2) courses and distances from a concrete monument set on
the southerly line of Sound Avenue: (1) South 21 degrees 30 minutes East 172.50 feet and (2)
South 43 degrees 08 minutes 50 seconds East 27.50 feet and from said point of beginning running
thence South 43 degrees 08 minutes 50 seconds East 113.65 feet to a point; running thence South
26 degrees 57 minutes 20 seconds East 240.00 feet to a point; running thence South 63 degrees
02 minutes 40 seconds West 200.00 feet to a point; running thence North 26 degrees 57 minutes
20 seconds West 353.61 feet to a point; running thence South 67 degrees 09 minutes 00 seconds
West 72.29 feet to a point; running thence North 21 degrees 29 minutes 40 seconds West along
land of Sabat 54.00 feet to a point; running thence South 79 degrees 00 minutes 40 seconds East
100 feet to a point; running thence North 77 decrees 30 minutes 40 seconds East 143.62 feet to the
point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed
dated 12/1/09 in the office of the Suffolk County Clerk on 2/23/10 in Liber 12617 page 45.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first pad, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.
