Southold, New York 11971, Individually and as Executor of the Last Will and
Testament of PETER A. JACQUES, late of Southo]d, Suffolk County, New York,
who died on the 28~t day of Juue, Two thousand Ten, party of the first part, and
JEAN MANOGUE, residing at 21250 Via Liago, Perris, CA 92570, and PETER
J. JACQUES, residing at 4079 Maiu Bayview Rd., Southold, New York 11971 tis
Trustees of THE MARY F. JACQUES IRREVOCABLE TRUST u/a 2/9/12 as to a
one-half interest and JEAN MANOGUE, residing at 21250 Via Liago, Perris, CA
925'70, as Trustee of the Peter A. Jacques Credit Shelter Trust u/a 8/25/05, as to a
one-half interest, party of the second part,
WITNESSETH, that the party of the first part, to whom Letters Testamentary were
issued by the Surrogate's Court, Suffolk County, New York on December 2, 2010,
and by virtue of the power and authority given in and by said Last Will and
Testament, and/or by Article I1 of Estates, Powers and Trusts Law, and in
consideration of Ten ($10.00) Dollars, paid by the party of the second pan, docs
hereby grant and release unto the party of the second part, the distributees or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with buildings and improvements
thereon erected, situate, lying and being at Bayview, Town of Southold, County of
Suffolk, State of New York, known and designated as aud by the Lot #24 on a
certain map entitled, "Map of Terry Waters at Bayview, Town of Southold, Suffolk
County, N. Y." and filed in the Office of the Clerk of the Couuty of Suffolk oil
December 29, 1958 as Map//2901.
TOGETHER with an easemeut for ingress and egress over and upon Watersedge
Way, Longview Lane, and Rambler Road for their entire distance as shown and lain
out, 50 feet wide throughout, on said above mentioned filed map.
TOGETHER with the right to use in common with other lot owners, the area known
as Lot//8 and the area adjoining next southerly thereto Io the extent of 80 feet, more
or less, being the northerly 80 feet of the parcel designated on said filed map as
"Community Park and Beach (residents only)".
TOGETHER with the right to use in common with other lot owners (said right
being only for the benefit of the above described premises) for bathing and
recreatioual purposes, the southerly 300 feet, more or less, of the parcel designated
on the above mentioned filed map as "Conrmunity Park and Beach (residents
ouly)".
SUBJECT 'FO the restrictions set forth in a declaration made and recorded by the
seller on September 8, 1958, in the Suffolk County Clerk's Office iu Liber 4508 cp
380 and repair of the roads, basins, canals and the parcel designated "Community
Park aud Beach (residents only)".
BEING AND INTENDED TO BE tile same premises conveyed to P[I'ER
JACQUES aud MARY JACQUES, his wife, by deed from LILLIAN JACOBSON
dated April 4, 1978 and recorded iu the Suffolk County Clerk's Office in Libor
8411 at page 28 on April 10, 1978, the said interest of MARY JACQUES having
been disclaimed by MARY JACQUES by DISCLAIMER and RENUNCIAIION
of TESTAMENTARY DISPOSITION filed in the Suffolk County Surrogate's
Court on March 28,2011.
PREMISES ALSO KNOWN as 360 Longview Lane, Southo[d, New York.
Together with all right, title and interest, if any, of the party of the first part in and
to auy streets and roads abutting the above-described premises to the center lines
thereof;
Together with the appurtenances and all the estate and rights of the party of the first
part in and to said premises;
To have and to hold the premises herein granted unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever.
And the party of the first part covenants that the party of the first part has not done
or suffered anything whereby the said premises have been encumbered in any way
whatever, except as aforesaid.
And the party of the first part, in compliance with Section 13 of the Lien Law,
covenants that the party of the first part will receive the consideration for this
conveyance and will hold the right to receive such consideration as a trust fund to
be applied first for the purpose of paying the cost of improvement and will apply the
same first to the payment of the cost of the improvement before using any part of
the total of the same for any other purpose. The word "party" shall be construed as
if it read "parties" whenever the sense of this indenture so requires.
