BETWEEN
MURIEL L. SChnffINDT, residing at 5425 North Bayview Road, Southold, New York 11971, as
surviving tenant by the entirety of Edward Schwindt, Jr., deceased on June 2, 2006, party of the first part, and
PAMELA J. HALDAS, residing at 275 Christopher Street, Southold, New York 11971, party of
the second part,
WITNESSETH, that the party of the first part, in consideration often dollars and other valuable consideration
paid by the party of the second part, does hereby remise, release and quitclaim unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate
lying and being in the Town of Southold, at Bayview, County of Suffolk and State of New York, bounded and
described as follows:
BEGINNING at an iron pipe on the Easterly line of the North Road to Bayview at the Southwesterly comer
of land of Gendron (lot 18), from said point of beginning: RUNNING along said land of Gcndron North 63
degrees 51 minutes 40 seconds East }45.5t feet to an iron pipe; THENCE along land conveyed or about to
be conveyed to Dahlstrom (lot 34) South 68 degrees 37 minutes 30 seconds East 127.93 feet to an iron pipe
on the Westerly line of a proposed 50 foot highway to be known as "Forest Drive", a/k/a Ship's Drive;
THENCE along said Westerly line of "Forest Drive", a/k/a Ship's Drive, two courses as follows: (1)
Southwesterly on a curve to the right having a radius of 192.93 feet a distance of 143.10 feet to an iron pipe;
(2) South 63 degrees 51 minutes 40 seconds West 101.62 feet to an iron pipe on said Easterly line of the North
Road to Bayview; THENCE along said Easterly line North 26 degrees 08 minutes 20 seconds West 145.0 feet
to the point of BEGINNING.
TOGETHER with a right-of-way over said proposed 50 foot highway to be known as "Forest Drive", from
the Northeasterly comer of the premises Southwesterly to the North Road to Bayview
SAID PREMISES being known as North Bayview Road, Southold, New York and being designated as
District 1000, Section 079, Block 03.00, Lot 021.00.
THE PARTY OF THE FIRST PART named herein is the sole lifetime beneficiary of the "Muriel L. Schwindt
Trust" dated /'~rT,f~7, // ,2012, during the lifetime of the Party of the First Part
and is entitled to all available veterans and senior exemptions as provided under RPTL subsections 458(7),
458-a(5) and 467(9), and the school tax relief(STAR) exemption as provided under RPTL section 425.
TOGETHER with all the right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party
of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
