Applicant is requesting relief from the code, which states that any accessory buildings must be built in the rear yard. CTM No. 103-13-20.1 REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law q267-b(3)Co)(3](1). Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. A driveway from Pequash Avenue, a well-traveled town street, from the proposed garage is proposed at only 20 feet. When cars axe backed out from the proposed garage onto this well traveled town street, there could be hazards to other drivers or others in the area due to poor visibility. Also, the distance from the garage is 20 feet from the side yard, which would cause a loss of privacy to the neighbor. 2. Town Law ~267-b(3)(b)(2]. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has three front yards, which prevents any accessory buildings from being constructed in a yard other than in a side yard or front yard. Additional Information: There has been opposition to placement of the proposed garage by the adjacent (southerly) property owner and by the Property Owners Association. The Applicant states the north and east portions of the property are heavily vegetated with some very desirable plantings that he does not want destroyed 3. Town Law ~267~b(3)(b)(3). The variance granted herein is substantial. The code states that no accessory buildings are allowed in other than the rear yard. Mr. Scheublein'e property has no rear yard. 4. Town Law ~267-b(3)(b)(5). The difficulty is not self-created. The lot has always had three front yards. 5. Town Law ~267-b(3~(b~(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The driveway proposed by the applicant is only 20' long and the cars would have to back out onto busy Pequaeh Avenue, and the conditions are related to the grant of the variance. Also, no other accessory building is only 20 feet from Pequash Ave. 6. Grant of the requested relief for the shed is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a garage or a shed, while preserving and protecting the neighborhood and the health, safety and welfare of the community. At 1.2792 acres, the parcel is one of the largest lots in the neighborhood. The house was built prior to 1957 and is located 36.6' from West Creek Avenue and 51.3' from the southern property line. There is a thick growth of mature specimen rhododendrons and trees on the northern third of the property. The eastern yard is landscaped and planted with grass and gardens. There is hedging, trees and shrubs at the southern boundary of the property. The area immediately west of the house is landscaped with the rest of the western portion of the property being mostly overgrown with scrub trees, vines and shrubs. The parcel is surrounded on three sides by roadways (Pequash Avenue to the east, Old Pasture Road to the north, and West Creek Avenue to the west). The property, therefore, has three front yards according to the Town Code. Unaware of the forgoing Code provision, Applicant began construction of an 8' x 12' accessory shed to the south and east of the dwelling. Upon learning of the restriction with regard to front yard structures, Applicant immediately ceased construction of the shed and consulted with the Southold Building Department. Applicant seeks variances to build the 8' x 12' shed and a detached two-car garage in the southwestern corner of the premises. That portion of the property has the least desirable vegetation. Both the garage and the shed will be located at least 15' from the southern property line. Access to the garage would be off of Pequash and located approximately 200' south of the intersection of Pequash and Old Pasture. The structures would be screened from the neighbors and the street by remaining vegetation. 1. An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties, if granted, because: (a) The street scape would be maintained and the mature specimen bushes and trees preserved. (b) The proposed location will preserve the privacy of the applicant and his neighbors. (c) In the interest of safety, the access driveway is located approximately 200' south of the Pequash-Old Pasture intersection. (d) The garage will be used for storage and restoration of antique cars. Accordingly, the driveway will not be heavily used.
