WITNESSETH,that the party of the first part,in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,

BEING AND INTENDED TO BE the same premises conveyed to the
party of the first part, as tenant by the entirety with William J.
Mallon, now deceased, by deed of Alexander & Evelyn Calabrese,
dated February 10, 1976 and recorded on February 19 , 1976 in the
Office of the Clerk of Suffolk County in Liber 7990, at page 558 .

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of tIlc first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the It

the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.

SCHEDULE A
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected, situate, lying and being near Mattituck, Southold Town, Suffolk
County, New York, bounded and described as follows:
BEGINNING at a point on the easterly line of Marlene Lane, 968.44 feet southerly
along said line from the southeasterly line of the Main Road (Route 25) being the
southwesterlyy corner of land conveyed by William F. Abitz and Edward 6;. Abitz to
James H. MacLellen and wife, and running along said land of James H. MacLellan and
wife, North 69 degrees 20 minutes 50 seconds East, 154.12 feet to the West line of
land of William F. Abitz and Edward G. Abitz;
THENCE along said land of William F. Abitz and Edward G. Abitz, South 21 degrees
O1 minutes 50 seconds East, 75.0 feet to land heretofore conveyed by William F. Abitz
to Theodore W.C. Switsavage and Eleanor Switsavage, his wife, by deed dated June

27, 1952, in Liber 78 of deed cp 504;
THENCE along said land so conveyed South 69 degrees 20 minutes 50 seconds West,
154.61 feet to the easterly line of Marlene Lane;
THENCE along said land easterly line of Marlene Lane North 20 degrees 39 minutes
10 seconds West, 75 feet to the point or place of BEGINNING.
TOGETHER with an easement for passage between Peconic Bay Boulevard and
Peconic Bay over a certain 10 foot right of way, in common with all others now having
such right of way and those to whom hereafter such right of way and easement may be
granted, which right of way is more particularly described as follows:
ALLthat parcel of land situate near Mattituck, Southold Town, Suffolk County, New
York, bounded and described as.follows:
THE Easterly line of subject 10 foot right of way is described as follows:
BEGINNING at a point on the Southerly line of Peconic Bay Boulevard, 200.20 feet
westerly along said line from the northeasterly corner of land of Haggerty Estate; adn
running along said land of Haggerty Estate on a line parallel to the easterly line of said
land of Haggerty Estate and 200.0 feet westerly therefrom South 20 degrees 23 minutes
00 seconds East, 500 feet, more or less to ordinary high water mark of Great Peconic
Bay; the westerly line of said 10 foot right of way is parallel to and 10.0 westerly from
the easterly line herein described and runs from Peconic Bay Boulevard to Great
Peconic Bay.
Said Easement is subject to the following covenants and conditions:
1. Said easement is for foot travel only.
2. It shall not be obstructed in any way and the maintenance thereof shall be the joint
responsibility of all those having a right to use said right way for the time being.
3. Said easement shall be perpetual and shall run with the land but no easment or rights
in said right of way shall vest in the general public. It shall be a private right of way.

beach or park described in correction dedication deedpdated May 4, 1955 and recorded
in the Suffolk County Clerk's Office in Liber 3881 cp 472.
