GARNER, residing at 102 Washington Avenue, Greenport, New York, as surviving tenant by the entirety party ofthe first part, and ff~(] ~--'] ~-3~'~ ~ 34 DAVID GARNER, residing at 4247 Mia Lane, Doylestown, Pennsylvania 18901; and JEAN McGEE, residing at 10 Flocee Lane, Hampton Bays, New York 11946 party of thc second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuablc consideration paid by the party of the second part, does hereby grant and release unto the party of thc second part, the heirs or successors and assigns of the party of the sccond part forever, PARCEL I:- ALI, THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being near the Village of Greenport, Town of Southold, County of Suffolk, State: of New York, described as Lot No. 46 on Map of Washington Heights made by Otto W. Van Tuyl dated December 8, 1927, which map is on file in the office of the Clerk of Suffolk County, Map No. 651, said premises being bounded northerly by Lot No. 45 as shown on said Map, 50 feet, easterly by Booth Place, 120 feet, ,southerly by Washington Avenue 50 feet, and westerly by Lot No. 47 as shown on said Map, 120 feet. BEING AND INTENDED TO BE the same prenfises conveyed to the party of the first part and David A. Garner, now deceased, by deed from Anna Marie Reiter dated February 28, 1948. and recorded in the Suffolk County Clerk's Office on March 2, !948, i~: Liber 2803 page 343. PARCEL II:- ALL THAT CERTAIN plot, piece or parcel of land, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known and described as Lot No. 47 on Map of property known as Washington Heights, filed in the office of the Clerk of Suffolk County as Map No. 651, said lot being bounded and described as follows:- Northerly by Lot No. 44 as shown on said Map, 50 feet; Easterly by Lot No. 46 as shown on s,aid Map, 120 feet; Southerly by Washington Avenue, 50 feet; and Westerly by Lot No. 48 as shown on said Map, 120 feet; BEING AND INTENDED TO BE the same premises conveyed to the party of the first part and David A. Garner, now deceased, by deed from Anna Marie Reiter dated October 14, 1954, and recorded in the Suffolk County Clerk's Office on October 22, 1954, in Liber 3778 page 189. RESERVING, HOWEVER, a legal life estate in the above-described premises with'the buildings and improvements thereon erected, in and to tile party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as they may choose, to change their remainderlnan as follows: TO or among any one or more members of a class consisting of the party of tile first part's descendants, in any degree, whether presently living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as tlw party o!' the first part lnay direct and appoint during their lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint themselves, their estates, their creditors or the creditors of their estate, under any circumstances. TOGETHER with all right, title and interest, if any, of tile party of thc first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rigbts of tbe party of thc first part in and to said premises; TO HAVE AND TO HOLD the premises berein granted unto the party of' thc second part, the heirs or successors and assigns of the party o£thc sccond part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as ~ trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to thc payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
