THIS INDENTURE, made t~he (,, day of December, Two Thousand
NANCY J, KOEHLER, residing at 4000 State Route 370, Yellow Springs, Ohio 45387,
party of the first part, and
THOMAS MARZANO, residing at 16 Hofstra Drive, Smithtown, New York 11787
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being near Greenport, in the Town of Southold, County of Suffolk
and State of New York, and bounded and described as follows:
BEGINNING at the comer formed by the intersection of the southerly side of Champlin Place
with the westerly side of Manhasset Avenue;
THENCE along the said westerly side of Manhasset Avenue South 20 degrees 12 minutes 30
seconds East 110.0 feet to land now or formerly of Valerie M. Kramer;
THENCE along said land now or formerly of Kramer South 49 degrees 38 minutes 50 seconds
West 109.96 feet to land now or formerly of Bette Thelma Woody;
THENCE North 31 degrees 24 minutes 40 seconds West along lands 125.00 feet to the
southerly side of Champlin Place;
THENCE along the southerly side of Champlin Place North 58 degrees 35 minutes 20 seconds
East 130.00 feet to the comer at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Mary C. Zipkas, dated November 28, 1981, and recorded December 11, 1981, in
the Office of the Clerk of the County of Suffolk in Liber 9114, Page 425.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof, TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
