TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting
the above described premises to the center lines thereof; TOGETHER with the appurtenances and ail the estate and rights
of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law, hereby covenants that the party of the
first part will receive the consideration for this conveyance andlwlll hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party' shall be construed as if it read "parties"; whenever the sense of this indenture so requires.

situate, 'lying and being in the Town of Southold, County of Suffolk and State of New York, being
bounded and described as follows:
BEGINNING at a monument set on the southerly side of a certain right of way 16.00 feet in width,
distant 1650 feet more or less easterly from Main Road to the northwesterly comer of the following
described parcel; running thence south 47 degrees 08 minutes 30 seconds East 94.77 feet to a
concrete monument; thence South 20 degrees 28 minutes 30 seconds West 158.00 to a concrete
monument; thence North 37 degrees 54 minutes West 124.71 feet to a point; thence North 28
degrees 40 minutes 30 seconds East 130.00 feet to a concrete monument set on the southerly line of
a certain 16.00 right of way, the point or place of beginning.

northeasterly comer of said land; runaing thence along the underwater land now or formerly of said
Howard Zehner the following two (2) courses and distances: 1) South 65 degrees 28 minutes 30
seconds West 70.71 feet 2) North 69 degrees 31 minutes 30 seconds West 72.81 feet to underwater
land now or formerly of Joseph Knizak; thence North 28 degrees 40 minutes 30 seconds East 116.59
feet to the southwesterly comer of land now or formerly of William Kilian; thence southeasterly
