Dear Mr. Haje:
The Department has reviewed your January 2, 1991 letter and revised plan.
Although the plan has been revised to eliminate the need for a variance from
the required 75 foot setback from tidal wetlands , the applicant's proposal
still requires a significant variance from the 40,000 square foot lot size
requirement. This is not acceptable to the Department since alternatives exist,
such as constructing one dwelling on the entire lot.
In addition, SEQRA .lead agency coordination for this proposal can not be
completed because the Southold Department of Planning and Town Board -of Appeals
have not yet received applications from Mr. Romeo. Please contact Mr. Robert
G. Kassner at the Town Planning Board Offices at (516) 765-1938 for additional
information.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because Applicant owns two contiguous parcels under two deeds (Lot
13 Liber 7557 pg. 82 and Lot 13 A Liber 7557 pg. 84). Applicant also receives
two separate tax bills. Due to the fact the two parcels are contiguDW and are
held by the same person, this Variance application is required to separate same.
Both parcels are water front properties and thus uniquely valuable,tand to deny
this apiilication would be not only a practicah difficulty for the applicant but would
also be a financial hardship. To deny the Variance would result in an oversized
parcel in the neighborhood, particularly since Lot 13 A is bounded on the North by
Meadow Lane (a private road). Applicant seeks to build on one parcel and sell the
other.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because Applicant owns two contiguous
parcels on a filed map.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the Variance would approve two parcels which
have merged because of common ownership and the two parcels would be in keep-
ing with the geneaal size and shape of other parcels in the neighborhood.
