PRATe and FRANClNE PRATe, his wife, residing at 580 Wiggins Lane,_ Greenport, NY 11944 party ofthefirstpart, and WESTBURY PROPERTIES, with a place of business at 31 Tennyson Avenue, Westbury, NY 11590, party of the second part, Witnesseth, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, All that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York, known and designated as Lots 165 to 167 inclusive as shown on a certain map entitled, "Amended Map A, Peconic Bay Estates," and filed in the Suffolk County Clerk's Office on May 19, 1993 as Map No. 1124, being bounded and described as follows: BEGINNING at a point on the easterly side of Kerwin Boulevard distant 33.46 feet southerly from the corner formed by the intersection of the southerly side of Lawrence Lane with the easterly side of Kerwin Boulevard; THENCE North 55 degrees 01 minutes 00 seconds East 178.61 feet; THENCE South 59 degrees 35 minutes 40 seconds East 55.00 feet; THENCE North 55 degrees 01 minutes 00 seconds East 55.00 feet to the center line of a gutter and land now or formerly of Seaman; THENCE southerly along the center line of a gutter 100.00 feet more or less to land of the Long Island Railroad; THENCE South 55 degrees 01 minutes 00 seconds West along the last mentioned land 254.00 feet to the easterly side of Kerwin Boulevard; , THENCE North 34 degrees 59 minutes 00 seconds West along the easterly side of Kerwin Boulevard 150.00 feet to the point or place of BEGINNING. BEING AND INTENDED TO be the same premises conveyed to the party of the first part herein by deed dated 7/1/87, recorded on 7/14/87 in Liber 10364, cp. t02. Together with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutling the above described premises to the center lines thereof;, Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises; To Have and to Hold the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. And the parbj of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. Ahd the parbJ of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the dght to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
