WITNESSETH, that the party of the first part, in consideration ofTen Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party
of the second part, the heirs or successors and assigns of the party of the second part forever,

Southold, County of Suffolk, and State of New York, known and designated as a 10 foot wide
drainage right of way between Lot No. 29 and Lot No. 30, as shown on a certain map entitled,
"Map of Southold Shores at Arshomomaque, Town of Southold, Suffolk County, New York,"
made by Otto W. Van Tuyl and Son, licensed land surveyors, Greenport, NY, dated July 1,
1963, and filed in the Office of the Clerk of the CoUnty of Suffolk on August 29, 1963, as
Map No. 3853.
TOGETHER WITH ingress and egress over Albacore Drive to the nearest public highway.
BEING AND INTENDED TO BE the same premises conveyed to Harold Reese a/k/a Harold
Reese, Jr. by deed from Fred Reese and Harold Reese, dated October 29, 1991, and recorded
in the Suffolk County Clerk's Office on August 10, 1992, in Liber 11516 page 395.

Southold, County of Suffolk and State of New York, known and designated as Lot No. 29, as
shown on a certain map entitled, "Map of Southold Shores at Arshomomaque, Town of
Southold, Suffolk County, New York", made by Otto W. Van Tuyl and Son, Licensed land
surveyors, Greenport, NY, dated July 1, 1963, and filed in the Office of the Clerk of the Count),
of Suffolk on August 29, 1963, as Map No. 3853, which said lot is being more particularly
bounded and described as follows:
BEGINNING at a point on the northerly side of Albacore Drive, distant 491.86 feet southeasterly
from the coreer formed by the intersection of the northerly side of Albacore Drive and the
easterly side of Main Road (State Road 25);
RUNNING TFi~ENCE North 26 degrees 07 minutes 30 seconds East, 175.00 feet to a proposed
canal;
THENCE along said proposed canal, South 63 degrees 52 minutes 30 seconds East, 110.00 feet
to the westerly side ora 10 foot wide drainage right of way;
THENCE along the west side of said 10 foot wide drainage right of way, South 26 degrees 07
minutes 30 seconds West, 175.00 feet to the northerly side of Albacore Drive;
THENCE along the northerly side of Albacore Drive, North 63 degrees 52 minutes 30 seconds

BEING AND INTENDED TO BE the same premises conveyed to Harold Reese a/k/a Harold
Reese, Jr~ by deed from Fred Reese and Harold Reese, dated October 30, 1991, and recorded in
the Suffolk County Clerk's Office on August 10, 1992 in Liber 11516 page 398.
"Regulated tidal wetlands associated with Southold Bay are located at Suffolk County
Tax Map Number: District 1000, Section 57, Block 01, Lots 18 & 19, otherwise known as the
properties of Pamela R. Dyer and her heirs, assigns, or successors. This property is subject to the
provisions of New York State Environmental Conservation Law (ECL) Article 25 or its
successor, and the conduct of regulated activities may occur only pursuant to ECL Article 25 if
prior approval is given by the New York State Department of Environmental Conservation
(NYSDEC) or its successor. Regulated activities include, but are not limited to the erection of
any structure(s); excavation; dredging, grading and filling; clearing of vegetation; and
application of chemicals"
TOGETHER with ail right, title and interest, if any, of the party of the first part in and to any
streets .and roads abutting the above described premises to the center lines thereof, TOGETHER
with appurtenances and ail the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as trust fund to be applied first for the purpose of paying the
cost,., of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
