THIS INDENTURE, made the ~ ~ day of May, Two Thousand One

the Estate of Theodore A. Fiedler, ~a Theodore Fiedlcr, who died intestate on the 27th day of April,

WITNESSETH, that whereas letters of administration were issued t_~o the party of the first part by the
Surrogate's Court, Suffolk County, New York on May 31, 200 ,0~-and by virtue of the power and
authority given by Article 11 of the Estates, Powers and Trusts Law, and in consideration of One
Hundred Forty Four Thousand Two Hundred ($144,200.00) Dollars, paid by the party of the second
part, does hereby grant and release unto the party of the second part, the distributees or successors and
assigns of the party of the second vart f6rever,
ALL that certain lSlot, piece or parcel of land, with the buildings and improvements thereon erected,
situate, lying and being in the Village of Greenport, Town of Southold, County of Suffolk and State of
New York, bounded and described as follows:
BEGINNING at a point on the easterly side of Sixth Avenue at the southwesterly corner of the
premises herein described and the northwesterly corner of land now or formerly of Ging ahd also
being distant northerly 297.5 feet from the corner formed by the intersection of the northerly side of
Front Street (S.R. 25) and the easterly side of Sixth Avenue;
RUNNING THENCE North 14 degrees 46 minutes 40 seconds East along said easterly side of Sixth
Avenue, 50.00 feet to a p!pe and land now or formerly of Peterson;
THENCE South 76 degrees 14 minutes 00 seconds East along said land now or formerly of Peterson,
110.00 feet to Lot No. 31 on Map of "Diagram of Land of Nathan Kaplan" and filed 1/15/1875 as
Map No. 338.
THENCE South 14 degrees 46 minutes 40 seconds West along said land, 50.00 feet to land now or
formerly of Ging;
THENCE North 76 degrees 14 minutes 00 seconds West along said land now or formerly of Ging,
110.00 feet to the easterly side of Sixth Avenue and the point or place of BEGINNING.
BEING AND INTENDED TO BE the same prer~ises conveyed to party of the first part by deed from
Harry W. Smith and Mary Louise Smith, dated October 1, 1955, and recorded October 19, 1955, in
the Suffolk County Clerk's Office in Liber 3997, Page 309.
TOGETHER with all right, title and interest; if any, of the party of the first part in and to any streets
and roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment of~he cost of improvement before using any part of the total of the
'same for any other purpose.
The word "party" shall be construed as if it reads "parties" whenever the sense of this indenture so
requires.
