JAMES P. KAVANAGH, residing at (Nog) Maple Lane, Greenport, New York.
party of the first part, and
BP, lAN K. KAVANAGH, residing at (Nog) Middleton Road, Greenport, New York
party of the second part,
WITNESSETH, that the party of the first part, in consideration' of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL TllAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being near Greenport, Town of Southold, County of Suffolk and State of
New York, known and designated as Unit No. 7 on a certain map entitled, "Map of Crescent
Beach 'Condominium", filed in the office of the Clerk of the County of Suffolk as Map No.
62, said lot being more particularly bounded and described as follows:-
BEGINNING at a point iff division line bet~.land described herein and land now or

THENCE South 11 degrees 49 minutes 30 seconds West along land now or formerly of Dawn
Estates, 474.34 feet to mean high water mark of Gardiner's Bay;
THENCE westerly along said high water mark; 200 feet to land now or formerly of Dawn
Estates;
THENCE North 31 degrees 15 minutes 50 seconds West along said land, 653.61 feet to a
point;.
THENCE North 56 degrees 29 minutes 10 seconds East, 270.08 feet to land now or formerly
of Rutkowski;
THENCE along said land the following courses and distances: (1) South 33 degrees 30
minutes 50 seconds East, 287.54 feet, and (2) North 85 degrees 45 minutes 20 seconds East,
250 feet to the point or place of BEGINNING.
TOGETHER WITH a right of way from the northwesterly corner of the premises northerly .~.
about 2100 .feet to the Main Road over Maple Lane as the same is shown on Map of Section 1,, s ~..
Cleaves Po!nt, filed in the Suffolk County Clerk's Office September 10, 1957, as Map 2752.
SUBJECT TO a 'fight of way 15 feet in width running from the northerly end of Maple Lane
to the northwesterly corner of the premises, thence easterly along the northerly boundary of
the premises about 270 feet, thence southerly along the easterly line of the premises and land
of Rutkowski about 287 feet; thence southeasterly along other land of Rutkowski about 250
feet to other land now or formerly of Bernard Kaplan.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed from Bernard Kaplan and Theodore Kaplan d/b/a Dawn Estates Shopping Center dated
April 20, 1965, and recorded in the Suffolk County Clerk's Office on April 23, 1965, in Liber
5734 page 346.
TOGETHER with ail right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
..premises; TO HAVE AND TO HOLD the premises herein 'granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the pa~ of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first p.art,'in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will 'receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be air,lied.first for the purpose of paying the cost of
the improvement and will apply '[he' same first to the payment of the cost of the improvement
before using any part of the total of the sam~ for any other purpose.
The word' "party" shail be construed as if it read "parties" whenever the sense of this indenture so
requires.
