HIS INDENTURE
Made the 24th day of August
Two Thousand
Between PATRICIA C. DUDLEY residing at P.O. Box 116, Port Kent,
New York 12975-0116 as Executrix of the Last Will and Testament of Ethel G.
Dudley, late of the City of Plattsburgh, Clinton County, New York deceased,
hereinafter referred to as the "Grantor", and
DAVID W. BELL and RICHARD A. BUCKHEIT residing at
125 Prospect Place, Apt. 5, Brooklyn, N.Y. 11217
hereinafter referred to as the "Grantee",
AS JOINT TENANTS WITH RIGHTS OF SURVIVORSHIP
(the words "Grantor" and "Grantee" shall be interpreted in the singular or plural, as the case may be)
WiPr~sse~h that the Grantor, by virtue of the power and authority to
her given in and by the said Last Will and Testament, and in consideration of
TWO HUNDRED SEVENTY-SIX THOUSAND DOLLARS ($276,000.00) lawful
money of the United States, paid by the Grantee, does hereby grant and release
unto the Grantee, Grantee's heirs and assigns forever, ALL THAT CERTAIN
PLOT, PIECE OR PARCEL OF LAND, together with the buildings and
improvements thereon situate, lying and being at Arshamomaque, Town of
Southold, County of Suffolk and State of New York, bounded and described as
follows:
BEGINNING at an iron pipe set on the boundary line between land of
the party of the first part, and land now or formerly of Adam Pekunka, 262.25
feet easterly along said line from it's intersection with the easterly line of land
now or formerly of Charles S. Sage;
RUNNING THENCE along said land of Pekunka, North 52 degrees 20
minutes East 42.50 feet to land now or formerly of Jones;
THENCE along said lands of Jones the following two courses as
follows:
(1) South 26 degrees 53 minutes 30 seconds East 152.25 feet;
THENCE (2) South 53 degrees 28 minutes 00 seconds East 141.89 feet to
the ordinary high water mark of the creek;
THENCE along said ordinary high water mark of the creek the
following (3) courses and distances:
1. South 40 degrees 43 minutes 15 seconds West, 39.39 feet;
2. North 85 degrees 50 minutes 25 seconds West, 38.64 feet;
3. North 69 degrees 28 minutes 49 seconds West, 52.76 feet to land now
or formerly of Burkhardt;
THENCE along said land of Burkhardt, North 26 degrees 53 minutes 30
seconds West 227.44 feet to the point of beginning.
Subject to right of way of McBride, Matassa, and Weston, and their
successors in title, over the northerly 16 feet of said premises.
TOGETHER with all the right, title and interest of the party of the first
part of, in and to such portion of said Creek as abuts the premises.
TOGETHER with an equal right with other owners of land along the
Creek abutting the above described premises to such right as the party of the
first part has of access to Peconic Bay over the waters of said Creek.
TOGETHER with a right of way in common with others 16 feet in
width from the northeasterly corner of the premises hereinabove described,
in a general easterly direction about 700 feet to a proposed highway to be
known as "Island View Lane," shown on "Amended Map A-Peconic Bay
Estates," filed in Suffolk County Clerk's Office as Map No. 1124, the northerly
and westerly line of said right of way being described as follows: Beginning at
the northeasterly corner of said premises and running along land of Pekunka,
two courses, as follows: (1) N. 52020' E. 102.75 feet; thence (2) N. 26053'50'' W.
118.07 feet; thence on the following two courses to said "Island View Lane":
(1) N. 36010'20'' E. 140.06 feet; thence (2) S. 85040' 30" E. 326.65 feet to a point
16 feet easterly from the westerly end of the southerly line of said "Island
View Lane".
Also, a right of way in common with other over said "Island View
Lane" from said 16 foot right of way easterly about 500 feet to Bayshore Road,
shown on said filed Map No. 1124, and also continuing easterly over said
"Island View Lane" about 175 feet to Peconic Bay.
TOGETHER with an equal right with others to use for purposes of
ingress, egress, parking, general beach use, the following described parcel of
land: Beginning at a point on the Southerly line of said proposed highway to
be known as "Island View Lane: at the northeasterly corner of land now or
formerly owned by Melvin Greer, said point being S. 23031' W. 52.94 feet from
the southwesterly corner of Lot No. 78 shown on said file Map No. 1124;
from said point of beginning running along said southerly line of said "Island
View Lane", S. 85040'30'' E. 16.60 feet; thence four courses as follows: (1) S.
11010'30'' E. 135.40 feet; thence (2) N. 78049'30'' E. 9.0 feet; thence (3) S.
11010'30'' E. 77.0 feet; thence (4) S. 60046' E. 163.38 feet to a point on ordinary
high water mark of Peconic Bay which is 200 feet southerly from the
southerly line of lands now or formerly owned by Horton Barr; thence
southerly along said ordinary high water mark of Peconic Bay to a point
which is S. 13030' E. 200.0 feet from the last described point; thence at right
angles to the last described course S. 76030' W. 80.0 feet to ordinary high water
mark of the creek; thence northerly along said ordinary high water mark of
the creek to a point which is N. 10038'20'' W. 200.25 feet from the last
described point; thence westerly along ordinary high water mark of the creek
to the southeasterly corner of said land of Melvin Greer, being N. 83022' W.
91.38 feet from the last described point; thence along said land of Melvin
Greer, two courses, as follows (1) N. 7050'30'' W. 130.0 feet; thence (2) N.
11010'30'' W. 167.85 feet to the point of beginning
SUBJECT TO easements, conveyances, restrictions and municipal
takings of record.
BEING a portion of the lands conveyed by deed from Frank E. Horn to
Maurice J. Dudley and Ethel G. Dudley dated March 28, 1956 and recorded in
the Suffolk County Clerk's Office April 13, 1956 in Liber 4097 of Deeds at Page
188.
Maurice J. Dudley died April 21, 1984 a resident of Suffolk County, New
York survived by his wife, Ethel G. Dudley. Ethel G. Dudley died testate
May 9, 1999 a resident of Clinton County, New York. Letters Testamentary
were granted by the Clinton County Surrogate's Court to ?atricia C. Dudley on
June 23, 1999.

Together
with the appurtenances and also all the estates which the
said Testatrix had at the time of her decease, in said premises, And also the
estate therein, which the Grantor has or had power to convey or dispose of,
whether individually, or by virtue of said Will or otherwise.
To have and to ~£dthe premises herein granted unto the Grantee,
Grantee's heirs and assigns forever.
Attdsaid Grantor covenants that he/she has not done or suffered
anything whereby the said premises have been encumbered in any way
whatever.
B~at in compliance with Sec. 13 of the Lien Law, the grantor will
receive consideration for this conveyance and will hold the right to receive
such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of
the cost of the improvement before using any part of the total of the same for
any other purpose.
