NEWSOME, husband and wife, residing at 1901 S. Roosevelt Blvd, Apt. S401, Key West, Florida 33040, and FRANCES E. NEWSOME, residing at 71304 DeLalre Landing Road, Philadelphia, Pennsylvania 19114, as joint tenants with rights of survivorship, party of the second part, WlTNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being at Arshamomoque, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at an iron bolt set on the southerly line of Island View Lane, 156.74 feet westerly along said southerly line from a monument at the northwesterly comer of land conveyed by Frank E. Horn to Horton Bart, said point of beginning being t.he northeasterly comer of land of Heffernan (formerly Greer); from said point of beginning running along said land ofHeffeman, 2 courses as follows: (1) S. 0° 30' 30" E. - 193.0 feet to an iron bolt; thence (2) S. 14° 00' 30" E. - 70.00 feet to an iron pipe at ordinary high water mark of the creek; THENCE northwesterly and then westerly along said high water mark 100 feet, more or less, to land of Weiner; THENCE along said land of Weiner and passing through an iron pipe, N. 4° 19' 30" E. - 230 feet, more or less, to an iron pipe on said southerly line of Island View Lane; THENCE along said southerly line of Island View Lane, S. 85° 40' 30" E. - 59.50 feet to the point of BEGINNING. TOGETHER with a right of way over said Island View Lane to Bayshore Road shown on filed map #1124 and also continuing easterly over said Island View Lane about 175 feet to Peconic Bay. TOGETHER with an equal right of way with John Newsome and Mary Newsome and with other persons to whom John Newsome and Mary Newsome have conveyed or may convey to use for purposes of ingress, egress, parking, general beach use, the following described parcel ofland: BEGINNING at a point on the southerly line of said proposed highway to be known as "Island View Lane", at the northeasterly corner of land conveyed by John Newsome and MaT Newsome to Greet, said point of beginning being S. 23o 31' W. 52.94 feet from the southwesterly comer of lot #78 shown on said filed map #1124; from said point of beginning running along said southerly line of said "Island View Lane", S. 85° 40' 30" E. - 16.60 feet; THENCE along said land of John J. Newsome, Jr. and Lois J.~ Newsome and others four courses as follows: (1) S. 11° 10' 30" E. - 135.40 feet; thence (2) N. 78° 49' 30" W. - 9.0 feet; thence (3) S. 11° 10' 30" E. - 77 feet; thence (4) S. 60° 46' E. - 163.38 feet to a point of ordinary high water mark of Peconic Bay which is 200 feet southerly from the southerly line of Horton Bart; THENCE southerly along said ordinary high water mark of Peconic Bay to a point which is S. 13° 30' E. - 200 feet from the last described point; THENCE at right angles to the last described curve S. 76° 30' W. - 80.0 feet to ordinary water mark of the creek; THENCE northerly along said ordinary high water mark of the creek to a point which is N. 10° 38' 20" W. - 200.25 feet from the last described point; THENCE westerly along ordinary high water mark of the creek to the southeasterly comer of said land of Melvin Greet, being N. 83° 22' W. - 91.38 feet from the last described point; THENCE along said land of Melvin Greer tWO courses as follows: (1) N. 7° 50' 30" W. - 130.00 feet; thehce (2) N. 11° 10' 30" W. - 167.85 feet to the point of beginning. Except, however, that John Newsome and Mary Newsome reserve the right to raise a bulkhead along said beach if they so describe in the future while still providing, however, adequate general beach use to the party of the second part. This conveyance is subject to the following restrictions: No. building shall be erected on the said premises within four (4) feet of the northerly or southerly line thereof. No livestock, except domestic pets, shall be kept on the said premises, and no breeding of livestock, domestic pets or birds shall be permitted thereon. No trees shall be removed from said premises except to allow for erection or expansion of buildings and except such trees as may require a removal because of disease or other hazard. No building other than a private dwelling for one family and private garage shall be erected on said premises. No building or buildings shall be erected on said premises unless said building shall be of standard construction and all materials on the ou~tside thereof shall be new materials. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from John Newsome and Mary Newsome, dated November 3, 1975, and recorded in the Suffolk County Clerk's Office on November 18, 1975, in Liber 7944, Page 261. TOGETHER with all right, title and interest, if any, of the pa~ty of the first part in and to any streets and roads abutting the above, described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund tobe applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
