party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever,
All that certain plot piece or parcel of land, situate, lying and being in the Town of
SOUTHOLD, at SOUTHOLD, County of Suffolk and State of New York being bounded
and described as follows:
BEGINNING at a point on the westerly side of a 25 foot wide right of way, said point
being distant 258.00 feet northerly from the intersection of the southwesterly corner of said
25 foot wide right of way and the northerly side of Main Road; THENCE from said point
of beginning, south 85 degrees 08 minutes west, 51.00 feet to a point; THENCE south 4
degrees 52 minutes east, 156.00 feet to a point; THENCE south 89 degrees 15 minutes 30
seconds west, 191.31 feet to lands now or formerly of LaColla; THENCE along said lands,
north 5 degrees 17 minutes east, 150.00 feet to shore line of Mill Creek; THENCE along a
tie line at Mill Creek, north 28 degrees 21 minutes 50 seconds east, 104.72 feet to a point;
THENCE north 86 degrees 08 minutes east, 158.00 feet to the westerly side of Right of
Way; THENCE along the westerly side of said Right of Way, south 4 degrees 52 minutes
east, 93.00 feet to the point or place of BEGINNING.
Being and intended to be the same premises conveye~to the Grantor by deed dated 8/12/58 and recorded 8/12/58 in
Liber 4498, cp 285.
TOGETHER with all right, title and interest, if any, of the party of the lirst part of, in and to any streets and roads abutting the
above-described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the
party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part. the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the lirst part has not done or suffered anything whereby the said
premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the lirst part, in compliance with Sec.tion 13 of the Lien Law, covenants that the party of the lirst part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of paying the cost of the improvement and will apply the same lirst to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
