SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply stating that this application is considered a matter for local determination as lhere appears to be no significant county-wide or inter-community impact. BASIS OF APPLICATION: Request for a Vadance under Section 280-124A, based on an application for a building permit and the Building Inspector's March 5, 2009 Notice of Disapproval concerning raised patio and swimming pool construction which will be less than the minimum code-required 40 fi. front yard setback on this 31,915 square foot parcel LWRP DETERMINATION: This application has been reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. A letter dated June 19, 2009 was received from the LWRP Coordinator Mark Terry, stating that based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP RELIEF REQUESTED: The applicant proposes Io construct a raise terrace at a 7 fl. front yard setback from Crabbers Road, an in ground swimming pool at a 12 ft, front yard setback from Crabbers Road right, of-way where the code requires a minimum 40 foot front yard setback. Page 2-aury 21, 2009 .ZETA FILE #6290- SFqRO GEROULANOS, Applicant CTM 104-9-13 at 2130 Bmadwatsm I~,ad and Crad~ Road, Cutchogue ADDITIONAL INFORMATION: The applicant submitted an alternate site plan for lhe pmpoeed raised tmrace and pool to the NYS DEC which located the conslruction on ~ seaward side of the existing dwelling at 50 feet from the wellands along Haywaters Cove. (See site plan by Gan~tt A. Strang, Architect, dated 3-21-08 labeled drawing No. SP-1). This altemate site plan would not have required a fTont yard setl~ack variance from Ute Board of Appeals. This plan received approval from the Southoid Town Board of Trustees (See letter daled March 19, 2008). However it was denied by the NYS DEC because it failed to meet Article 25 Section 661.9(b)(1)(i) and (iv) of the Environmental Conservation Law. The DEC recommended the placement of a proposed raised terrace and in ground pool in place of the applicant's as built non-confon'ning raised wood deck on fie northeasterly side of b~e house, for which a variance for a 14 ft. setback from Crabbers Road was granted by the Board of Appeals on November 6, 2003 (No. 5400). (See letter fi'om the DEC dated May 14, 2008). The applicant's revised site plan b the subject of the relief in this vadance application. REASONS FOR BOARD ACTION: On the basis of tastirnony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law .~257-1x'3)¢bl{3)!11. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a de,merit to nearby properties. There is an existing raised wood deck and hot tub on the subject property with a non-conforming 14 ft. front yard sethack from Crabbers Road, which is a narrow paper road that is unopened. The applicant has a driveway over Crabbers Road ~ight-of-way for access to his property from Broadwaters Cove Road and the adjacent land on the opposite side of the pager mad which lhe applicant also owns. There are significant slopes on the subject property which require re-grading for the proposed raised terrace, pool, and lawn areas that are not typical of other structures in the front yards of neighboring propertiee. The Board, in granting alternative relief, seeks 1o minimize the visual impact lhat the proposed construction will have on Broadwaters Cove Road as well as Crabbers Road right-of-way from both front yards on the subject propen'y. 2. Town Law §267-b{3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasibte for the applicant fo pumue, other than an area variance because the existing dwelling is selback 39 feet +1- from Crabbers Road right-of-way, and the NYS DEC required Ihe applicant to construct the proposed raised terrace and pool in the front yard facing Crabbers Road in place of a non-conforming as-built deck and hol tub structure. 3. Town Law 6267-bi3)lbl[31. The vadsoce as applied for is substantial, The code requires a minimum fl'ont yard setback of 40 ft. The pre-existing non-conforming setbad( of the as built raised wood deck and hot tub is 14 feet which is a 65% variance Eom the code. Since the proposed cortsth~on involves the dernolitkm of the existing wood deck, and Crabbers Road is an unopened paper right-of-way, the Board of Appeals seeks to reduce the proposed new non-conformity by granting Alternative Setback Relief from Crabbers Road right-of-way for a minimum of 15 feet, which is a 62.5% variance from the code. 4. Town Law .~267-b(3)~bll'5). The difficulty has been serf-created, however, the proposed location is the result of the NYS DEC denial of a request to place a raised lenace and pool in a location that would not have required a front yard setback variance. 5. Town Law ~267-b13){b}~41. No evidence has been submitted to suggest that a vadance in this residential community will have an adverse impact on lhe physical or environmental conditions in the neighborhood. A latter dated June 23, 2009 from Nicole Spinelli of the County of Su~lk Soi! and Water Conservation Ois~ct indicated that no natural resources concerns were observed on the subject property with regard to the proposed co~lmction of a raised terrace, in ground swimming pool and retaining walls. The site plan submitted includes a proposed drywell for bolh pool water backwash and roof mn off. 6. Town Law ,~267-b. Grant of altemative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a raised terrace, swimming pool and retaining walls, while presewing and protecting the character of Ihe neighborhood and the health, safety and welfare of fie community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Weisman, seconded by Chain~an Goehringer, and duly carried, to DENY as applied for, and further to GRANT ALTERNATIVE RELIEF as noted below and subject to the following CONDITIONS: 1. The sethack from Crabbers Road for the proposed accessory struclure shall be 15 feet. 2. A new site plan showing pool location at 15 ft. f~om Crabbers Road, all retaining walls, drywells for pool water back~ash and roof runoff ,evergreen screening, and the location of mechanical equipment for the pool in the Broadwaters Cove Road front yard, shall be submitted to the Board of Appeals before a building permit is issued. 3. Pool equipment shall be housed in a sound proof container. 4. The pool and raised terrace shall remain open to the sky. 5. A line of evergreen trees, minimum 5 feet tall, planted 4 feet on center, shall be located beiween and parallel to the proposed raised ten'ace/pool and Broadwaters Cove Road for a length of 40 feet (+/-) to create privacy screening. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the variance given such as extensions, or demolilioas which am not shown no the apl~ican~s diagrams or survey site maps, are not authorized under this application when involving nonconfom~i~es under the zoning code.
