by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns to the par~y of the second part forever,
SEE EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF FOR LEGAL DESCRIPTION
TOGETHER with all rights, title and interest, if any, of the party of the first part in and to any streets and roads abutting the
above described premises to the center lines thereofi TOGETHER with the appurtenances and all the estate and rights of the
party of the first pan in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the saint
premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will
receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied
first for the purpose of p~ying the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

EXHIBIT "A'
ALL that certain lot, piece or parcel of land, situate, lying and being in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the notthefly side of North Road, also sometimes known as "Old
Kings Highway" where the extreme southerly end of the dividing line between the premises
herein and land formerly of one Charles Butt intersects said northerly side of North Road,
running thence along said dividing line North 13° 18' 30" West 441 feet, more or less, to the high
water mark of Long Island Sound, thence southeasterly along said high water mark of Long
Island Sound 170 feet, more or less, to a point thereon which is 364 feet, more or less, northerly
from the northerly side of North Road, drawn on a line at right angles thereto, the southerly end
of which is 150 feet easterly from the point of beginning, thence South 13° 18' 30" East along the
westerly boundary line of land now or formerly of one Dave Driscoll 364 feet, more or less, to
the northerly side of North Road, thence along the northerly side of North Road, South 77° 23'
West 150 feet to the point or place of BEGINNING.
SUBJECT to covenants, conditions, restrictions, reservations, easements, rights and rights of
way of record, if any, of record.
EXCLUDING, however, the following described premises, which portion of the above-described
premises was conveyed to Patrick J. Cunningham and Rosina B. Cunningham by deed dated
August 26, 1959 as recorded in the Suffolk County Clerk's Office.
ALL, that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New
York, bounded and described as follows:
BEGINNING at a concrete monument on the northerly side of North Road, also sometimes
known as "Old Kings Highway", which monument is at the southeasterly comer of land now or
formerly of Charles Burt, and the southwesterly comer of the premises herein described; from
said point of beginning, running along said land now or formerly of Charles Burt, North 13
degrees 18 minutes 30 seconds West a distance of 441 feet more or less, to the ordinary high
water mark of Long Island Sound;
thence running along said ordinary high water mark of Long Island Sound in a southeasterly
direction measured on a tie-line bearing south 74 degrees 06 minutes 40 seconds East a distonce
of 85.91 feet;

13 degrees 18 minutes 30 seconds East a distance of 400 feet more or less to the northerly side of
North Road;
