or successors and assigns of the party of the second part forever,

HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns
the party of the second part forever.

AND the party of the first part, n cbmpliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part o£ the total of the same for
any other purpose.

PREMISES:

ALL that certain plot, piece or parcel of land with the
buildings and improvements thereon erected, situate, lying and
being in the Town of Southold, County of Suffolk and State of New
York, known and designated as Lot No. 41 as shown on a certain
map entitled ~Map of Southold Shores at Arshamomoque, Town of
$outhold, Suffolk County, New York" made by Otto W. Van Tuyl and
Son, licensed land surveyors, Greenport, N.Y. dated July 1, 1963
and filed in the Office of the County Clerk of Suffolk County,
New York on August 29, 1963 as Map No. 3853.
BEGINNING at a point on the southerly side of Tarpon Drive
distance 340.00 feet southeasterly from the corner formed by the
intersection of the southerly side of Tarpon Drive and the
easterly side of Main Road (State Route 25);
Running thence along the southerly side of Tarpon Drive
South 63 degrees 52 minutes 30 seconds East 115.00 feet;
Running thence South 26 degrees 07 minutes 30 seconds West
175.00 feet to a proposed canal;
Running thence along said proposed canal North 63 degrees 52
minutes 30 seconds west 115.00 feet;
Running thence North 26 degrees 07 minutes 30 seconds East
175.00 feet to the southerly side of Tarpon Drive at the point or
place of BEGINNING.
TOGETHER with the right, title and interest of the party of
the first part of, in and to the land under waters of Peconic Bay
adjoining said premises on the south and to the Highway adjoining
said premises on the north, to the center line thereof.
TOGETHER with the party of the first part's right, title and
interest to the land under water of the basin which lies within
the above described property, subject only to the rights of
ingress and egress over surface of water by previous grantees of
party of the first part.
TOGETHER with the rights'pr the party of the second part,
its heirs, and assigns, to use and ~intain, at its own expense~
the existing inlet from Peconic Bay to the basin adjoining the
premises on the East. Said inlet to be no more than fifty (50)
feet in width unless party of the first part, his heirs and
assigns, approve in writing. This right is intended to be the
same heretofore granted to Fred W. Young and others and shall be
in common with party of the first part, his heirs and assigns.
In the event the present inlet in relocated by grantor, grantee
or Fred W. Young, then present inlet shall be closed and all
common rights above stated as to ingress, egress and right to
maintain shall apply to said relocated inlet.
BEING AND INTENDED to be the same premises heretofore conveyed to
the party of the first part by deed dated October 29, 1991 and
recorded in the office of the Clerk of the County of Suffolk on
August 10, 1992 in Liber 11516 page 390.
Subject to the following:
(1) Zoning regulations and ordinances of the Town of Southold.
(2) Any state of facts an accurate survey might show.
(3) Covenants, easements and restriction of record, if any.
