THIS INDENTURE, made the ~ day of August, in the year Two Thousand
BETWEEN,
WILLIAM F. SUDA, residing at 10 Lois Circle, Monroe, CT 06468, and GEORGE A, SLIDA,
residing at 1109 Edinburgh Drive, Jamestown, NC 27282, as co-executors of the last will and testament
of JOSEPH W. SUDA, who died on the 2nd day of November, nineteen hundred and ninety-nine, the

WILLIAM F. SUDA, residing at 10 Lois Circle, Monroe, CT 06468, and. GEORGE A. SUDA,
residing at 1109 Edinburgh Drive, Jamegtown, NC 27282, party of the second part,
WITNESSETH, that the party of the first part, to whom letters testamenta~J were issued by the
Surrogate's Court, Suffolk County, New York on May 4, 2000, and by virtue of the power and authority
given in and by said last will and testament and/or by Article 11 of the Estates, Powers and Trusts Law,
and in consideration of TEN ($10.00) DOLLARS, paid by the party of the second part, does hereby
grant and release unto the party of the second part, the distributees or successors and assigns of the party
of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land with the buildings and improvements thereon
erected, situate, lying and being at Arshamomoque, Town of Southold, County of Suffolk and State of
New Ybrk, bounded and described as follows:-
BEGINNING at a monument.on the southwesterly line of a certain right of way leading southeasterly
from the Main Road, at the n0rthwesterly corner-of land conveyed by Charles S. Sage and Vera Y. Sage
to John I-Iiggins, and from said point of beginning
RUNNING along said land of Higgins and passing through an iron pipe South 28 degrees 40 minutes 30
seconds We~t, 138.0 feet to the shore of the basin;
THENCE through the waters of said basin, North 63 degrees 15 minutes 10 seconds West, 190.94 feet to
said shore of said basin;
THENCE along land conveyed by Charles S~ Sage and Vera Y. Sage to Christensen and passing through
an iron pipe, North 24 degrees 48 minutes 50 seconds East, 133.0 feet to a monument on said
southwesterly line of said right of way;
THENCE along said southwesterly line two courses, as follows: (1) South 65 degrees 11 minutes 10
seconds East, 100.0 feet to an iron pipe; thence (2) South 64 degrees 11 minutes 10 seconds East,
100.13 feet to the point of BEGINNING.
TOGETHER WITH a right of way over said right of way from the northeasterly corner of the premises
northwesterly about 1440 feet to the Main Road.
TOGETHER WITH, in common with others, the right of ingress and egress to and from Peconic Baya
over the waters of the~basin adjoining premises, including the same rights and privileges grantors have as
to entrance to basin through land of Fred Young.
TOGETHER WITH the right to erect a wharf 50 feet in length into said basin from premises, but said
wharf shall be located at least 25 feet in from either side line of premises.
Grantees shall have the privilege of dredging out the basin adjoining their premises and mooring a boat at
any bulkhead on premises.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the firs( part has or has
the power to convey or dispose of, whether individually, or by virtue of said will or otherwise,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever.
AND tlie party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section. 13 of the Lien Law, covenants that the party
of the first part will receive'the consideration for-t~s conveyance and will hold the right to receive such
consideration as a trust, fund to be. applied first for'f he purpose of paying the cost of improvement and
will apply same first to the payment'~Sflhe cost of improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it' reads "parties" whenever the sense of this indenture so
requires.
