D~ 'i) \~ \ CUI .~ \~f WIT N E SSE T H \', WHEREAS, Declarant is the owner in fee simple of a certain parcel land situate at Southold, Town of southold, County of Suffolk and State of New York, containing 7.592 a!=,res, and designated on the Suffolk county Tax Map as District 1000, Section 059, Block 07, and Lot 031.000; being the same premises conveyed to Declarant by deed dated February 18, 1985, recorded in the Suffolk County Clerk's Office on March 20, 1985, in Liber 9755, at page 416, and referred to herein DISTRICT 1000 SECTION as the "premises". 059.00 BLOCK 07.00 WHEREAS, residential to certain agreements. the Declarant intends to subdivide said and business purposes and desires to subject reservations, restrictions, conditions, premises for said premises covenants and LOT 03.<.000 NOW THEREFORE, the Declarants do hereby declare that the aforesaid premises and every portion thereof is hereby held and shall be conveyed subject to the conditions, covenants and restrictions hereinafter set forth, and that every purchaser of sa10 preY.iises so purchased shall be held subject to the covenants, conditions, and restrictions hereinafter set forth. 1. No lot shall be ~ubdivided or its lot lines changed in any manner at any future date unless authorized by the Town of Southold Planning Board. 2. All driveways on ~1iddle Road shall make an angle of at least 700 and preferably 900 with the county road. 3. Each lot having frontage on Middle Road shall have a turnaround provision, such as a T-shaped shunt, so that a vehicle leaving a lot will not have to back out into the traffic stream on the road. All stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the si te by adequate drainage structures so that it will not flow out onto the right-of-way of Middle Road. 5. These covenants will be effective only at such time as the Southold Town Planning Board endorses the subdivision map and said map is accepted by and filed with the Suffolk County Clerk. 6. That all of the covenants, conditions and restrictions contained herein shall be construed as real covenants running with the land and shall continue and remain in full force and effect at all times as against the owner of the premises or any portion thereof, except with the permission of the Southold Town Planning Board, or its then equivalent successor.
