roads abutting the above-described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first pan in and to said premises; TO HAVE AND TO HOLD
the premises herein granted unto the party of the second pan, the heirs or successors and assigns of the party of
the second pan forever.
AND the party of the first pan covenants that thc party of thc first pan has not done or suffered anything whereby
thc said premises have been incumbered in any way whatever, except as aforesaid.
AND the party oftbe first pan, in compliance with Section 13 of thc Lien Law, covenant~ that the party of the
lust pan will receive the consideratioff for this conveyance and will hold the right to receive such consideration
as a trust fund to be applied first for thc purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
~u~pose.
The word "party" shall be construed as if it read "panics" whenever the sense of this indenture so requires.

ALL that certain plot, piece or parcel of land, with the buildings and improvements
erected, situate, lying and being in East Marion, Town of Southold, County of Suffolk
and State of New York, known and designated as Lot No. 5, on a certain map entitled,
"Map of Section 1, Cleaves Point, and filed in the Office of the Clerk of the County of
Suffolk at Riverhead, New York, as Map No. 2752, on September 10, 1957, which
said lot is more particularly bounded and described as follows:
BEGINNING at a point on the easterly side of Osprey Nest Road distant 212 feet
southeasterly and southerly, when measured along the northeasterly and easterly side of
Osprey Nest Road, from the corner formed by the intersection of the northeasterly side
of Osprey Nest Road with the southeasterly side of Osprey Nest Road; said point of
beginning also being where the division line between lot no: 5 and lot no. 4 on the
above-mentioned map intersects the northeasterly side of Osprey Nest Road;
RUNNING THENCE north 82 degrees 37 minutes 10 seconds east along said
last-mentioned division line, 150.00 feet to land now or formerly of Dawn Estates Inc.;
THENCE south 0 degrees 22 minutes 40 seconds west, 124.15 feet to the division line
between lot no. 5 and lot no. 6 on the above-mentioned map;
THENCE north 79 degrees 30 minutes 00 seconds west along said last-mentioned
division line 140.00 feet to the easterly side of Osprey Nest Road;
THENCE north 7 degrees 22 minutes 50 seconds west along the easterly side of Osprey
Nest Road 80.03 feet to the division line first above-mentioned at the point or place of
