party of the first part, and
DESMOND J. KAVANAGH, residing at 904 S. Peninsula Drive, Daytona Beach, Florida 32118
as to an undivided twelve and one-half (12.5%) percent interest;
KATHLEEN A. INGRAHAM, residing at 64 Georgia Road, Freehold, New Jersey 07728 as to
an undivided twelve and one-half(12.5%) percent interest; and
KEV1N M. KAVANAGH, resid[ng at 12 Baldwin Avenue, PO Box 370, Pt. Lookout, New York
11569, as to an undivided twelve and one-half (12.5%) percent interest
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL TRAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being near Greenport, Town of Southold, County of Suffolk and State of
New York, known and designated as Unit No. 7 on a certain map entitled, "Map of Crescent
Beach Condominium," filed in the office of the Clerk of the County of Suffolk as Map No.
62, said lot being more particularly bounded and described as follows:-
BEGINNING at a point in division line between land described herein and land now or
formerly of Rutkowski, which point is set 669.70 feet west of Shipyard Lane;
THENCE South 11 degrees 49 minutes 30 seconds West along land now or formerly of Dawn
Estates, 474.34 feet to mean high water mark of Gardiner's Bay;
THENCE westerly along said high water mark, 200 feet to land now or formerly of Dawn
Estates;
THENCE North 31 degrees 15 minutes 50 seconds West along said land, 653.61 feet to a
point;
THENCE North 56 degrees 29 minutes 10 seconds East, 270.08 feet to land now or formerly
of Rutkowski;
THI~NCE along said land the following courses and distances: (1) South 33 degrees 30
minutes 50 seconds East, 287.54 feet, and (2) North 85 degrees 45 minutes 20 seconds East,
250 feet to the point or place of BEGINNING.
TOGETHER WITH a right of way from the northwesterly comer of the promises northerly
about 2100 feet to the Main Road over Maple Lane as the same is shown on Map of Section 1,
Cleaves Point, filed in the Suffolk County Clerk's Office September 10, 1957, as Map No.
2752.
SUBJECT TO a right of way 15 feet in width running from the northerly end of Maple Lane
to the northwesterly comer of the premises, thence easterly along the northerly boundary of
the promises about 270 feet, thence southerly along the easterly line of the premises and land
of Rutkowski about 287 feet; thence southeasterly along other land of Rutkowski about 250
feet to other land now or formerly of Bernard Kaplan.
BEING AND INTENDED TO BE the same promises conveyed to the party of the first part by
deed from James P. Kavanagh dated June 20, 2000, and recorded in the Suffolk County
Clerk's Office on September 7, 2000, in Liber 12068 page 772.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof, TOGETI~R
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the right to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
