marks the division line between lands now or formerly of Barnes and premises described herein;
RUNNING THENCE on a course South 46 degrees 09 minutes East along the westerly side ora private road a distance of
103.9 feeJ to lands now or formerly of McCabe;
RUNNING THENCE South 34 degrees 45 mihutes West along said lands a distance of 163.80 feet to the high water mark
of Arshamomoque Bay (8/I 7/2000);
RUNNING THENCE North 58 degrees 03 minutes 36 seconds West along said high water rnark a distance of 102.72 feet
to lands now or formerly of Barnes;
RUNNING THENCE North 34 degrees 45 rninutes East along said lands now or formerly of Barnes 185.26 feet to a
monument at the point or place of BEGINNING.
TOGETHER with a right of way over said private road 25 feet in width as same is now laid out to the North Road.

TOGETHER with all righ[~, title and int~st, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances, and also all
thq estate which the said decedent had at the time of decedent's death in said premises, and also the estate therein,
which the party of the first part has or has power to convey or dispose of, whether individually, or by virtue of said
will or otherwise; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the
said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the fu~t
part will receive the consideration for this conveyance and will hold the fight to receive such consideration as a trust
fund to be tlpplied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
