BEING and intended to be the same premises described in deed dated 12/2/88, recorded
12/21/88 in Liber 10761, Page 95.
TOGETHER with all right, titIe and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
~remises herein granted unto the party of the second part, the heirs or successors and assigns of the party of
the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part wll receive the consideration for this conveyance and will qold the right to receive such consideration
as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
purpose. The word "party" shall be construed as if it read "parties" when ever the sense of this indenture so
requires.

ALL that certain plot, piece or parcel of land, situate, lying and being at
Greenport, Town of Southold, County of Suffolk and State of New York,
bounded and described as follows:
BEGINNING at a point on the southerly side of Gull Pond Road (Lane) distant
1729.04 feet southerly and easterly as measured along the West and southerly
side of Gull Pond Road from the corner formed by intersection of the southerly
side of North Road with the westerly side of Gull Pond Road, said point of
beginning also being distant North 30 degrees 00 minutes West 275.00 feet
from the southwesterly corner of Gull Road Road;
RUNNING THENCE South 60 degrees 00 minutes West 620.00 feet to a point;
THENCE North 39 degrees 13 minutes 00 seconds West along land now or
formerly of Marcus 205.00 feet;
THENCE continuing to land now or formerly of Marcus the following three
courses and distances:
1) North 58 degrees 01 minutes 40 seconds East 358.80 feet;
2) North 27 degrees 58 minutes 30 seconds West 95.00 feet;
3) North 58 degrees 12 minutes 10 seconds East 338.36 feet to the southerly
side of Gull Pond Lane; and
THENCE RUNNING aIong the southerly side of Gull Pond Lane, South 13

or place of BEGINNING.
TOGETHER with a non-exclusive twenty foot right of way from the easterly end
of Gull Pond Road running from said Gull Pond Road to Gull Pond. Said
Easement being described as follows:
BEGINNING at a point on the easterly line of the 100 foot turnaround at the
southerly end of Gull Pond Road. Said point being the southwesterly corner of
land of Farrell and Lot 1 on "Map of Fordham Acres, Section One", filed in the
Suffolk County Clerk's Office as Map No. 3519; from said point of beginnin9.
RUNNING along said land of Farrell, four courses: 1) North 60 degrees 00
minutes East 48.30 feet; 2) THENCE South 47 degrees 00 minutes East 6.9 feet;
THENCE 3) North 43 degrees 00 minutes East 22.50 feet; THENCE 4) North 60
degrees 00 minutes East 68.00 feet to the ordinary high water mark of Gull
Pond;
THENCE southerly along the said ordinary high water to a point which is 20.0
feet from said land of Farrell;
THENCE South 60 degrees 00 minutes West 110 feet, more or less, to said
easterly line of the turnaround;
