STARON, residing at 1490 Waterview Drive, Southold, New York 11971; DONALD J. STARON, residing at 1780 Henry's Lane, Peconic, New York 11958; and RICHARD E. STARON, residing at 448 Pine Needles Lane, At'ton, Virginia 22920; party of the second part, WlTNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the; second part, the heirs or successors and assigns of the party of the second part forever, ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being at Greenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- BEGINNING at a point on the northerly side of Knapp Place, distant 444.81 feet easterly from the comer formed by the intersection of the northerly side of Knapp Place with the easterly side of Main Street; RUNNING THENCE North 26 degrees 26 minutes 10 seconds West along land now or formerly of Jomay Corp., 164.64 feet; THENCE North 74 degrees 33 minutes 30 seconds East along land formerly of Lillian R. Brown and now or formerly of Jomay Corp., 50.00 feet; THENCE South 26 degrees 32 minutes 00 seconds East along land now or formerly of Begley, 163.08 feet to the northerly side of Knapll Place; and THENCE South 72 degrees 43 minutes 40 seconds West along the northerly side of Knapp Place, 50.00 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed from Robert Benjamin Horton and Dorothy Adell Horton, his wife, dated September 1, 1966, and recorded in the Suffolk County Clerk's Office on September 9, 1966, in Liber 6029 page 118. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as ~they may choose, to change their remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descendants, in any degree, whether presently living or bom hereafter, in such proportions and amounts, without regard to equality, outfight or in trust, as the party of the first part may direct and appoint during their lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint themselves, their estates, their creditors or the creditors of their estate, under any circumstances. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any'part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
