AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party o~

eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the stone for
any other 'purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.

and State of New York, known as Lot 2 on a certain map entitled, "Map of August Acres" and filed in the Office of the
Clerk of the County of Suffolk on Jun 3, 1991 as Map No. 9107, bounded and described as follows:
BEGINNING at a point on the southwesterly side of Kerwin Blvd. where same is intersected by the division line between
lots 2 and 3 on the above described map;
RUNNING THENCE South 46 degrees 50 minutes 20 seconds West 257.97 feet;
THENCE North 43 degrees 09 minutes 40 seconds West 158.73 feet;
THENCE North 46 degrees 50 minutes 20 seconds East 280.74 feet to the southwesterly side of Kerwin Blvd.;
