No. 5184—WILLIAM SEIFERT Southold Town Clerk Property Location: 7145 Soundview Avenue, Southold 1000-59-6-3. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's 14,846 sq. ft. parcel has a frontage of 210.99 ft. along the north side of Sound View Avenue and average depth of 94 feet. The property is located in Southold and is improved with a single-family, two-story frame house as shown on the survey prepared by Peconic Surveyors, P.C. dated June 18, 2001, amended January 22, 2003. BASIS OF APPLICATION: Building Department's June 19, 2002 Notice of Disapproval, citing Sections 100-242A and 100-244B, in denying a building permit application for additions with setbacks at less than 35 feet from the front and rear lot lines. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on October 17, 2002 and January 16, 2003, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: Applicant wishes to construct a 16' x 24' one- story porch addition and an open, elevated, one-story deck addition at the rear of the dwelling, as shown on the January 22, 2003 revised map prepared by Peconic Surveyors, P.C. The additions are proposed with variable setbacks to the rear lot line, or edge of the pond, and at 20 feet to the front lot line facing Soundview Avenue. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Grant of alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The dwelling is existing with a front yard setback of 20.2 feet at the southeast corner, and a rear yard setback at least 35 feet from the northerly side of the dwelling. The neighborhood is developed with homes with • Page 3—January 23,2003 • Appl.No.5184—William Seifert 59-6-6 at Southold nonconforming yard setbacks that do not meet today's code requirements, and the alternative relief granted herein provides for a 10 x 20' porch instead of a 16' x 24' porch. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The lot is a shallow nonconforming with an area of 14,846 sq. ft. The Pond is located close to the dwelling and there is no other area available. The remainder of the lot is already occupied by walkways and similar landscaped areas, parking for the owners, sanitary and well systems. 3. The alternative relief is substantial, allowing for a reduction in the code setback from 35 feet to 20 feet as to the front yard, and from 35 feet to 34 and 49 feet, instead of the requested 28 ft. and 43 ft. feet, for the rear additions. 4. The difficulty was self-created and is related to the various requests for variances to build on the lot by the former owners and the applicants. 5. No evidence has been submitted to suggest that the proposed additions will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an open deck and porch additions to the dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Orlando, and duly carried, to DENY the variance as applied for, and GRANT Alternative Relief with the following CONDITIONS: 1. The rear yard setback for the open deck shall not be any closer than 27 feet as requested, and 2. The porch addition shall be reduced to 10' x 20' and with a setback of 34 feet, instead of the requested 28 ft. Specifically, the NYS DEC requires that we notch the referenced parking area around an existing large caliper tree. I trust this alteration is in keeping the intention of the ZBA. I am also in receipt of your recent resolution with respect to this application and respectfully request clarification with respect to the alternative relief granted. Our original application sought relief for a reduced frontyard setback of 20' from the required 35' based in part that the existing frontyard setback is 17.5'. The screenporch addition was also substantially reduced by the alternative relief granted from the requested 16' x 24' to 10' x 20' and requiring a rearyard setback of 34' instead of the requested 28'. My question is that the screenporch as applied for(16'x 24'), already met the required setback of 35', inasmuch as it its corners are 49' and 37' respectively from the edge of the pond (property line). The 28' referenced in the resolution is to the edge of the wetlands, which falls in the jurisdiction of the NYS DEC and Town Trustees. The Trustees have already issued a permit to construct to the 28' setback, copy of which is in your files and the NYS DEC has approved the same setback(28') (permit en route). It is my understanding that the relief sought from the ZBA was for the frontyard setback of 20' to the screenporch and a rearyard setback of 27' to the closest point of the elevated open deck only. The rearyard setback to the screenporch was never required to be part of the ZBA application, as per the Building Department's notice of disapproval. I would therefore appreciate the Board's reviewing the above at their earliest convenience and advising me accordingly. Thank you for your courtesy and cooperation in this matter. Seifert Alternative Relief— Soundview Avenue Architect Garrett Strang stopped by yesterday afternoon and asked whether it was the intent of the Board to limit the rear yard when it met the 35 ft. rear yard setback (although it was shown 28 ft. to the wetland/pond line). One option was to place the smaller 10x20 porch with a 20 ft. (or more) setback from the front line required in the ZBA decision, and with a rear yard setback to meet the Code minimum of 35 feet. Garrett indicated that the design is to allow for access from the existing 8 ft. wide sliding doors at the side of the house and with outside access from a walk. If the Board is not allowing the rear yard to be 35 ft., then he cannot design it to fit. Therefore he would need to know if he can go north as long as it is not less than a 35 ft. rear yard? (The Code setback restriction is 75 feet from freshwater wetlands, and the Board denied relief for a shed in the same general area in within 75 feet of the freshwater wetlands.) u , 1 A. Item C: Permittee Responsible for Obtaining Other Required Permits The permittee is responsible for obtaining any other permits,approvals,lands,easements and rights-of-way that may be required to carry out the activities that are authorized by this permit. Item D: No Right to Trespass or Interfere with Riparian Rights This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility,including relevant records,is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. General Condition 3: Applications for Permit Renewals or Modifications The permittee must submit a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC)and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. Submission of applications for permit renewal or modification are to be submitted to: NYSDEC Regional Permit Administrator, Region 1, SUNY Bldg #40, Stony Brook, NY 11790-2356 General Condition 4: Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations is found; b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d) environmental conditions, relevant technology, or applicable law or regulation have materially changed since the permit was issued. If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by the Department to remove or alter the structural work,obstructions,or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from the U.S.Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. 4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized. 7. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall,without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 8. If granted under 6NYCRR Part 608,the NYS Department of Environmental Conservation hereby certifies that the subject project will not contravene effluent limitations or other limitations or standards under Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977(PL 95-217) provided that all of the conditions listed herein are met. 9. At least 48 hours prior to commencement of the project,the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work and, if required, a survey. 10. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or his agent as part of the permit application. Such approved plans were prepared by Peconic Surveyors, dated June 18, 2001, and last revised December 17 2001. Any work,disturbance,and storage of construction materials shall be confined to within the"Limit of Clearing and Ground Disturbance" as shown on the approved plan. 2. Prior to commencement of any construction activities,a continuous row of straw bales shall be staked end to end along the limits of clearing,grading and ground disturbance,as shown on the approved plan. The bales shall be maintained, repaired and replaced as often as necessary to ensure proper function, until all disturbed areas are permanently vegetated. The average useful life of a bale is approximately 3-4 months. Sediments trapped by the bales shall be removed to an approved upland location before the bales themselves are removed. 3. Straw bales shall be recessed two to four inches into the ground. 4. Any demolition debris, excess construction materials, and/or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet from any regulated freshwater • wetland. These materials shall be suitably stabilized so as not to re-enter any water body, wetland, or wetland adjacent area. 5. All fill shall consist of clean soil, sand and/or gravel that is free of the following substances: asphalt, slag,flyash, broken concrete,demolition debris,garbage,household refuse,tires,woody materials including tree or landscape debris, and metal objects. The introduction of materials toxic to aquatic life is expressly prohibited. 6. All equipment and machinery shall be stored and safely contained greater than 100 feet landward of the regulated wetland or water body at the end of each work day. This will serve to avoid the inadvertent leakage of deleterious substances into the regulated area. Fuel or other chemical storage tanks shall be contained and located at all times in an area greater than 100 feet landward of the regulated wetland or water body. If the above requirement cannot be met by the permittee, then the storage areas must be designed to completely contain any and all potential leakage. Such a containment system must be approved by NYSDEC staff prior to equipment,machinery or tank storage within 100 feet of the regulated wetland or water body. 7. All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass, and mulched with straw immediately upon completion of the project, within two (2) days of final grading, or by the expiration of the permit, whichever is first. Mulch shall be maintained until a suitable vegetative cover is established. If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed as soon as weather conditions favor germination and growth. 8. Suitable vegetative cover is defined as a minimum of 85% area vegetative cover with contiguous unvegetated areas no larger than 1 square foot in size. 9. The permittee shall incorporate the following language as a notice covenant to the deed: "Regulated freshwater wetlands associated with SO-5 are located on or near the properties of William Seifert and his/her/their heirs, assigns or successors. This property is subject to the provisions of Environmental Conservation Law (ECL)Article 24, and the conduct of regulated activities may occur only pursuant to ECL Article 24 if prior approval is given by the New York State Department of Environmental Conservation (NYSDEC) or its successor(s). Regulated activities include, but are not limited to clearing of vegetation; application of chemicals; excavation; grading and filling; and erection of any structure(s)." This deed covenant shall be recorded with the Clerk of Suffolk County within 90 days of the issuance of this permit. The Board has granted alternative relief on this application by limiting the size of the screen porch to 10' x 20' and requiring it be set back 34'. The 10' dimension presents practical difficulties in that the south edge of the screenporch must fall between the existing sliding door and window. If it were to be 10' and placed as directed by the resolution,the south edge would fall in the middle of the existing window, as well as encroach further into the driveway. The 10' x 20' size equals 200 sq. ft.. A comparable 200 sq. ft. area can be attained by using dimensions of 13'4" x 15', which would allow for placement of the south edge of the screenporch between the door and window'Alper original application. It would also allow for alignment with the approved elevated wood walkway connecting the screenporch to the deck, also as per original application. This proposal provides a setback to both screenporch and approved walkway of 39'. In support of the above, I have enclosed seven(7)copies of an amended site plan along with a partial floor plan showing the relationship of the existing house and screenporch addition relative to this proposal. Please note the actual setback to the edge of pond/property line, under the original application is 37', and is now proposed to be 39'. The 28' setback dimension referred to in the resolution was to the edge of wetland, not property line. Page 5 of 128 • • Page 6 January 16, 2003 Southold Town Board of Appeals Regular Meeting Public Hearing GARRETT STRANG, ARCH: Good morning, Garrett Strang representing William Seifert. CHAIRWOMAN: At the last hearing we were a little concerned because we noted that there had been 3 prior decisions on this property and we wanted to check to see what the status of those was. To see we weren't really duplicating a prior variance and the upshot of it was that in 1986 the board had denied an accessory a 12x20' detached accessory addition at a 25' front yard and I believe the other one was 35' from the edge of the pond. At the time the board had cited environmental reasons closest to the wetland and the fact that there had been other priors on the property. As you know the ZBA had also granted a prior setback of the dwelling and I just want you to clarify something. I do note on the survey that the setback on the dwelling at the closest point is 17.5. MR. STRANG: That's correct as built. CHAIRWOMAN: So there's already encroachment on our prior condition. MR. STRANG: I thought the 17.5 was what was granted in the original variance when the building was built. CHAIRWOMAN: Not according to the records we have. The records we have show that the board had granted a 20' setback. It's possible that the encroachment, the little porch area entryway was added later. I don't know. MR. STRANG: Yes, I'm not exactly certain I wasn't involved with the project when the house was built or transpired at that time with respect to that, but I did note that the survey showed a 17 'A setback and again it's to the front covered porch area, portico. I'm not sure if the building department considered that exempt under that 30 sq. ft. situation or whatever I don't know what the deal is with that. CHAIRWOMAN: On the rear yard line is 27 the closest on that elevated deck around? MR. STRANG: 27 is actually to the steps, the deck itself is a little bit further back than that. CHAIRWOMAN: I see on the west side where it says proposed elevated deck it says 26 and then you see 27 and it juts out a little bit. MR. STRANG: It's 26 to the steps, it's 26 from one set of steps from the edge of the flagged wetlands. That was for DEC dimension. To the actual pond, it's 28' in the northwest corner and it's to the steps and it's 27'midway between there and the proposed porch that we asked for. And again those steps would probably take off a foot or two to increase the distance by another foot or two to the actual elevated deck surface itself. CHAIRWOMAN: My only comment is that the proposed addition is extremely similar to what was denied before on the grounds of environmental concerns and it's very difficult to go back and say well here we are 20 years later and we're not concerned about the environment. STRANG: I can appreciate that and I guess that's one of the reasons that I did in concurrence with this board go before the DEC and Trustees to see where they stood on this issue. Both felt that the screen porch being an elevated porch on posts and the fact that it was essentially being the majority of it was being built over an existing gravel driveway felt that the environmental impact was negligible and accordingly were granted permits. We've gotten permits from both the DEC and the Trustees to do what's shown here. The deck in question was actually the original proposal that my client preferred was to have a terrace of grade which wouldn't have even required an action but that aspect before the board but the DEC said they'd rather have it elevated and not have any additional hard surface on grade. CHAIRWOMAN: Because of the flood zone? MR. STRANG: They just felt it was better environmentally to have elevated decks so water can percolate through the deck surface and drip through the ground to have a hard surface where the water will run off so with that understanding we propose it as a deck by the time we came to you since that was the preference by the DEC. MEMBER GOEHRINGER: We originally and I may have said this in the record before sent Donald Dennis back 2 or 3 times during the prior hearing for the construction of this house and we told him at that time to build us a house that would fit within the confines of the property,just so you are aware of that situation. Regarding this particular project which I'm not saying is diminimus in reference to it's environmental situation but I understand why the DEC is requiring what is being required and I think that's a positive step. The only concern I have not as much with the project as where are the people going to park'? There is very limited parking there and by the construction of this you are taking away some of the parking from that driveway area. I mean it's the type of situation where if you blink you buy the house and you have to know where the driveway is. I don't foresee that you could accommodate more than 3 or 4 cars if you built this project if that, but we know the situation and I have to tell you that maybe the board would consider something a little less than you are proposing, but environmentally if you have those 2 agencies I don't have any major objection to the construction. STRANG: If the board is entertaining an alternative relief with respect to the porch or the possibility of reworking the driveway to provide more parking I'm sure I can make that happen. I don't think the owner would have objection to that, the only concern I would have with respect to that is what the Trustees or the DEC would have to say about increasing the parking area although it is a stone driveway, it's impervious surface so it will drain, but I can't speak for them until I take it back to them. They had no challenge or I shouldn't say they had no challenge they reviewed it and granted us approval for what has been submitted, but there was no representation at that time there would be a change in the parking area. CHAIRWOMAN: Is there something we could do without changing the plans that have been approved by the Trustees and DEC? MR. STRANG: The only obvious thing I could see is the parking were to move to the east somewhat to provide some additional parking which brings it closer to the easterly wetlands, but probably no closer than the 48' wetlands to the northeasterly corner of the screen porch. CHAIRWOMAN: I don't know if that's desirable. MR. STRANG: But it may allow someone to pull in and park facing easterly then as opposed to pulling in forward. Just so you know I don't want to go into the nitty gritty details but see the size of this file? This is the Werthner file from the time he went to contract to purchase this property to today. This property has gone through DEC, Trustees, and Health Department. It started out as 2 separate lots, Broshota owned the property and it was 2 lots. Mr. Werthner bought it and merged it and it's 1 house on a combined parcel of the subdivision. What occurred is Mr. Werthner after all was said and done he is the general contractor on the house he is building the house himself and he hired a mason to pour the foundation and when the foundation was poured, it was properly staked, the surveyor had properly staked everything, the mason accidentally misread the stakes and put the foundation too close to the road. What was to back up a little bit we have an average setback from the road because of the location of all the other homes in this neighborhood. The average setback originally if we took into account right next door is a garage, a large garage that has got space above it it's a 2 '/z car garage, larger than the house itself is only at 15' from the road. The road is actually a 50' ROW, but the opening, the opening of the road actually allows for another 20' of front yard to Mr. Werthner and some of the other property owners along the same side of the street. We originally thought there was a front yard setback of 26 but as it turns out, because we can't use the garage, it was a front yard average setback of 33.7. So we had an average setback of 33.7. When the foundation was poured, it was poured at 32.7 it was 1' off. That would not be too significant except for the fact that this house has a small porch on it.
