Not~'ry Public 7 cc: Applicant STATE OF NEW YORK DEPARTMENT OF STATE: 4 I STATE STREET ALBANY, NY 12231-0001 SOUTHERN REGION BOARD OF REVIEW In the Matter of the Petition of: Richard Lark, ESQ For an APPEAL to the New York State Uniform Fire Prevention & Building Code DECISION PETITION NO. 2000-1010 Upon the application of Richard Lark, ESQ, filed pursuant to 19 NYCRR 450 on August 15, 2001, and upon taking testimony and hearing argument thereon at a duly noticed hearing before the Southern Region Board of Review held in the Town of Brookhaven Office Complex, 3233 Route 112, Medford, New York, on September 5, 2001, and upon all other papers in this matter, the Board makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to additions and alterations to an existing building of Al(single family) occupancy, one story in height, of type 5b (wood frame) construction, approximately 1,236 square feet in gross area, located at 1005 Mason Drive, Cutchogue, Town of Southold, County of Suffolk, State of New York. The petitioner is seeking an appeal from: 9 NYCRR 7'17.3(f)('1), which requires that private garages in or attached to a dwelling shall be separated from other spaces in the building construction having a fire-resistance rating of at least ',/,-hour. Each opening in the separation between the garage and other space in the building shall be equipped with a self- closing door having a fire resistance rating of at least %-hour. Such door shall not open directly into a room used for sleeping purposes. [The petitioner requests an appeal of the Local Code Enforcement Officials interpretation of the above Code Section.] FINDINGS OF FACT 1. The building that is the subject of the petition is properly classified as a A1 (single-family) occupancy, of type 5b (wood frame) construction, located outside the fire limits. 2. A small room was added to the building in the garage, where the garage attaches to the main building. At that time, 5/8-inch fire rated gypsum board was installed over the common wall between the attached garage and the main building. Petition No. 2000-1010 Page 2 3. Upon final inspection of the addition and alteration, the local Code official asked that additional fire rated gypsum board be installed on the abutting ceiling and wall surfaces for a distance of 5 feet into the garage space and where there is no common wall. 4. Section 717.3(f)(1) only requires that private garages in or attached to a dwelling shall be separated from other spaces in the building by construction having a fire resistance rating of at least %-hour and that any openings in the separation between the garage and other space in the building shall be equipped with a self-closing door having a fire resistance rating of at least %-hour. Section 717.3(f)(1 ) does not provide for a 5 foot return of the raquirad fire separation into the garage space. 5. The old Code manual published in 1977 did have fire protection provisions that the local Code enforcement official is requiring. However, since the inception of the current Uniform Building Code in 1984, the older manual is no longer enforceable since it is not identified as a reference standard. Therefore, with the current regulations in effect, the additional five feet of %-hour fire protection is not required. CONCLUSION OF LAW In accordance with the above findings, the Board concludes that the %-hour fire resistance rating between the garage and other spaces of the building are not required to extend into the garage area. DETERMINATION WHEREFORE IT IS DETERMINED that the appeal of the Town of Southold Code Enforcement Official's determination that a violation exists to 9 NYCRR 717.3(f)(1 ), concerning fire separation, be and is hereby SUSTAINED, in favor of the Petitioner. Furthermore, it should be noted that the decision of this Board is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application.
