Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work. 3. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed fi.om the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 4. No Alteration of Bluff for Stairway Alteration of the existing grade of the bluff or hill during construction of the stairway is prohibited. 5. Stairway Design The stairway must be elevated a minimum of 3 feet over grade to minimize disturbance or loss of the natural vegetation and reduce the potential for causing or accelerating erosion of the bluff or hill. Disturbance to the natural vegetation or topography seaward of the crest (top) of the bluff or hill must be restricted to an 8-foot wide area, including the width of the stairway, as shown on the approved plans. 6. Equipment, Material Stored Away from Crest of Bluff The storage of construction equipment and materials shall be confined to upland areas landward of the crest of the bluff or hill. 7. Conformance With Plans All activities authorized by this permit must be in strict conformance with the approved plans submitted by the applicant or applicant's agent as part of the permit application. State May Order Removal or Alteration of Work If future operations by the State of New York require an alteration in thc position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the frcc navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State, the owner may be ordered by thc Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of thc watercourse hereby authorized shall not be completed, the owners, shall, without expense to thc State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of thc watercourse. No claim shall be made against thc State of New York on account of any such removal or alteration. 9. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 10. State May Require Site Restoration If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. GENERAL CONDITIONS - Apply to ALL Authorized Permits: I 1. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of thc Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. 2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a separate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental information thc Department requires. Any renewal, modification or transfer granted by the Department must be in writing. Submission of Renewal Application The permittee must submit a renewal application at least 30 days before permit expiration for the following permit authorizations: Tidal Wetlands. s. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions, relevant technology or applicable law or regulations since the issuance of the existing permit; noncompliance with previously issued permit conditions, orders of the commissioner, any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. ~i. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulation or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership. Metzger, L.S. was submittecL increasing the proposed setback from the toP of the bluff from 62 feet to 90 feet for the house and from 3Zfeet to 75 feet for the pool. LWRP DETERMI~JATION: A Letter to the Board of Appeas from Mark Terry, LWRP Coordinator, was received on Janqary 8, 2009, reporting a finding of inconsistency under Chapter 268, Waterfront Consistency RevieW, of the Town of Southold Code, and Local Waterfront Revitalization Program (LWRP) standards. The lettbr noted that the distance from the bluff for the trellis, swimming pool~ and residence (12 ! May 19, 2009 ,LE # ~237 - George Yatrakis 1000-51-1-14 feet, 32 feet, and §2 feet, respectively) were less than the minimum Cede required setback. The amended application, in acc~)rdance with the LWRP Coordinator's recommendations, mitigates the odginal proposal with respect to the,setbacks for the dwelling and swimming pool. A letter was also received on January 5, 2009 from the County of Suffolk Soil and Water Conservation District signed by Nicole Spinelli, Distdct Technician recommending the installation of a berm 'at the top of the bluff, with a d~ well to prevent runoff from flowing over the-edge of the bluff, and that irrigation be kept to a minimum to mimmize excess weight and stress On the bluff. FINDINGS OF FACT The Zoning Board of Ap-peals held public headngs on this application on January 8, 2009. and Apdl 23, 2009, at which times written and oral.evidence were presented, Based upon all testimony, documentation, personal .inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE~REUEF REQUESTED: The applicant requests a vadance to allow construction of a new dwelling 90 fe~t from the top of the bluff, a swimming pool 75 febt from the top of the.bluff, and a trellis 12 feet from the tog of the bluff in place of the existing remains of a shed. REASONS FOR B~ARD ACTION: On the basis of testimony presented, materials submitted and personal ~nspections the Bdard makes the follo~ng findings: 1. Town Law Section 267-b(3)(b)(1). Grant of the variances will not produCe an undesirable change in the character of the'neighborhood or a detriment to nearby properties, if the pre. existing shed, is removed and no trellis iS constructed in that location. The benefit of a dwelling and swimming pool where none exists cannot be achiev~ .by some method, feasible for the applicant to pursue, other than an area vanance. Placement of the house and pool at a reasonable distance from bluff would require a variance for ~etback from the road .~ 3. Town Law seq~onr267-b(3)(b)(3). The proposed variance is not substantial with respect to the hOuse and Swimming poc~l, for which 10 percent and 25 percent relief from code-required 100 feet are requested. A setback varianc~ilthat would allow a 12- foot sethacl~ for the trellis is substantial. 4. Town Law Section 267-b(3)(b)(5). The difficulty has been self-created so far as the applicant proposes to build a new house with nonconforming setbacks. 5. Town Law Sect'ion 267-b(3){b)(4). Evidence has been submitted to suggest that, because of the fragility of the bluff, a variance in this community may have an adverse impact on the physical or environmental conditions in the neighborhood.
