Bargain and Sale Dccd wilh Covenants Against Grantor's Acts - Individual or Corporation CONSULT YOUR LAWYER BEFORE SIGNING THIS INSTRUMENT - THIS INSTRUMENT SHOULD BE USED BY LAWYERS ONLY THIS INDENTURE, made the 31>~ t~ day of May, 2000 BETWEEN KENNETH H. DIMON, residing at 439 Main Street, Greenport, New York, 11944 party of the first part, KENNETH H. Champlin", and filed in the Office of the Clerk of the County of Suffolk on October 23, 1873, as Map Number 337, which said lots, when taken together, are bounded and described as follows: BEGINNING at a point on the southerly side of Knapp Place distant 119.0 feet easterly, as measured along the southerly side of Knapp Place from the corner formed by the intersection of the southerly side of Knapp Place with the easterly side of Sterling Place, said point of beginning being and intended to be where the division line between lots 52 and 53, as shown on the aforementioned map, intersects the southerly side of Knapp Place and from said point of beginning running thence along the southerly side of Knapp Place north 73 degrees 05 minutes 00 seconds east, 99 feet to land now or formerly of Norkelun; thence along land now or formerly of Norkelun and land now or formerly of Watson, south 33 degrees 18 minutes 30 seconds east, 150.60 feet to the northerly line of lot 57, as shown on the aforementioned map; thence along the northerly line of lot 57, as shown on the aforementioned map, south 73 minutes 27 minutes 20 seconds west 105 feet to the easterly line of lot 56, as shown on the aforementioned map; thence along the easterly lines of lots 56,55, 54 and 53, as shown on the aforementioned map, north 30 degrees 59 minutes 40 seconds west, 148.25 feet to the southerly ?ide of Knapp Plac~ at the point or place of beginning. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed dated April 20, 1999 recorded in the Office of the Clerk of the County of Suffolk on April 21, 1999 in Liber 11958 page 503. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof. TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said )remises. I'O HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first par[ has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND THE party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement, and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
