last will and testament of SELMA RUTH REESE aIkIa SELMA R. REESE aIkIa SELMA K.
REESE, who died on the 26th day of April, nineteen hundred and ninety-seven, (Suffolk County
Surrogate's Court File Number 2309 P 1998), the party of the first part, and

PAMELA DYER, residing at 6 Stafford Drive, South Huntington, New York 11746; FREDERICK
REESE, JR., residing at 14 East Avenue, Glen Cove, New York 11532; and CAROL REESE, residing
at 8 Octavio, Fort Pierce, Florida 34951, party of the second part,
WITNESSETH, that the party of the first part, to whom letters testamentary were issued by the
Surrogate's Court, Suffolk County, New York on December 16, 1998, and by virtue of the power and
authority given in and by said last will and testament and/or by Article 11 of the Estates, Powers and
Trusts Law, and in consideration ofTEN ($10.00) DOLLARS, paid by the party of the second part, does
hereby grant and release unto the party of the second part, the distributees or successors and assigns of
the party of the second part forever, all of the right title and interest of the Estate of Selma Ruth
Reese a/kla Selma R. Reese aIkIa Selma K. Reese
ALL THAT CERTAIN plot, piece or parcel of land with the buildings and improvements thereon
erected, situate, lying and being in the Town of Southold, County of Suffolk and State of New York,
known and designated as Lot No. 43 as shown on a certain map entitled, "Map of Southold Shores at
Arshamomoque, Town of Southold, Suffolk County, New York" made by Otto W. Van Tuyl and Son,
licensed land surveyors, Greenport, N.Y., dated July 1, 1963, and filed in the Office of the County Clerk
of Suffolk County, New York, on August 29, 1963, as Map No. 3853, being more particularly bounded
and described as follows:-
BEGINNING at a point on the southerly side of Tarpon Drive distant 110.00 feet southeasterly from the
comer formed by the intersection of the southerly side of Tarpon Drive and the easterly side of Main
Road (State Route 25);
RUNNING THENCE along the southerly side of Tarpon Drive, South 63 degrees 52 minutes 30 seconds
East, 115.00 feet;
RUNNING THENCE South 26 degrees 07 minutes 30 seconds West, 175.00 feet to a proposed canal;
RUNNING THENCE along said proposed canal, North 63 degrees 52 minutes 30 seconds West, 115.00
feet to the easterly side of a 10 foot wide drainage right of way;
RUNNING THENCE along the east side of said 10 foot wide drainage right of way, North 26 degrees
07 minutes 30 seconds East, 175.00 feet to the southerly side of Tarpon Drive and the point and place of
BEGINNING.
TOGETHER WITH the right, title and interest of the parties of the first part of, in and to the land under
waters of Peconic Bay adjoining said premises on the' south and to the Highway adjoining said premises
on the north, to the center line thereof.
TOGETHER with the party of the first part's right, title and interest to the land under water of the basin
which lies within the above-described property, subject only to rights of ingress and egress over the
surface of water by previous grantees of the parties of the first part.
TOGETHER WITH the right of the party of the second part, their heirs and assigns, to use and maintain
at their own expense, the existing inlet from Peconic Bay to the basin adjoining the premises on the East.
Said inlet to be no more than fifty (50) feet in width unless the parties of the first part, their heirs and
assigns, approve in writing. This right is intended to be the same heretofore granted to Fred W. Young
and others and shall be in common with the party of the first part, their heirs and assigns. In the event the
present inlet is relocated by grantor, grantee, or Fred W. Young, then the present inlet shall be closed and
all common rights above stated as to ingress, egress and right to maintain shall apply to said relocated
inlet.
BEING AND INTENDED TO BE the same premises conveyed to Selma Reese by deed dated October
30, 1991, and recorded in the Office of the Clerk of the County of Suffolk on August 10, 1992, in Liber
11516 page 385.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center line thereof,
TOGETHER with the appurtenances, and also the estate which the said decedent had at the time of
decedent's death in said premises, and also the estate therein, which the party of the first part has or has
the power to conveyor dispose of, whether individually, or by virtue of said will or otherwise, .
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the
distributees or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of improvement and
will apply same first to the payment of the cost of improvement before using any part of the total of the
same for any other purpose.
The word "party" shall be construed as if it reads "parties" whenever the sense of this indenture so
requires.
