PAINTER and ERNEST W. PAINTER, JR., wife and husband, residing at 150 Meadow Street, Garden City, New York, party of the first part, and MARILYN E. MORGAN, residing at 17892 88u' Road North, Loxahatchee, Florida 33470 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, PARCEL A: ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the Village of Greenport, Town of Southold, Suffolk, State of New York, bounded and described as follows: BEGINNING at the northeasterly comer of the premises conveyed and on the northerly side ora right of way hereinat~er mentioned and defined which line is also the southerly line of land now or formerly of Herbert Fordham at a point which is distant 860.18 feet westerly on a course of North 68 degrees 53 minutes 20 seconds West from a locust post set in the westerly line of land now or formerly of Inez Fordham, which point of beginning is the northwesterly comer of land heretofore conveyed by Sandy Beach Association of Greenport, N.Y., Inc. to Stewart; and from said point of beginning RUNNING THENCE westerly along the said northerly side of said right of way North 68 degrees 53 minutes 20 seconds West 37.28 feet, more or less, to lands now or formerly of Herbert Fordham; THENCE in a generally south direction and along the said lands now or formerly of Herbert Fordham 100 feet to a point at the southwesterly comer of the land granted by The People of the State of New York to the Sandy Beach Association of Greenport N.Y., Inc., which grant or patent is recorded in the office of the Secretary of State of the State of New York and also recorded in the office of the Clerk of Suffolk County, New York, and which point is the southwesterly cOmer of the premises herein conveyed; THENCE easterly and along the southerly line of said grant or patent, 24.87 feet, more or less, to the said land heretofore conveyed to Stewart; i THENCE northerly and along the said land now or formerly of Stewart 100.31 feet, more or less, to the northerly side of said right of way at the point or place of BEGINNING. The above mentioned courses, where used, being according to the true north meridian. TOGETHER with riparian rights in G-reenport Harbor in front of and abutting the premises herein conveyed. SUBJECT, however, to an easement by way of right of way over and upon the northerly 30 feet of the premises hereby conveyed, and together with an easement by right of way over other portions of the right of way which embraces the northerly 30 feet of the premises now or formerly of the Sandy Beach Association of Greenport, N.Y., Inc., between the lands of Inez Fordham on the east thereof and the lands of Herbert Fordham on the west thereof, and ALSO TOGETHER with a right of way in common with others upon, over and across a parcel of land adjoining said last mentioned right of way on the north thereof, and which parcel of land is referred to as Parcel "C' in the interlocutory judgment of 1929 in the partition action in the County Court of Suffolk County entitled "Archibald N. Young, Plaintiff, v. Nettie E. Hall, etal., Defendants," which said last mentioned fight of way extends north to Manhanset Avenue, and which said right of way is generally referred to as Beach Road. PARCEL B: ALSO all that certain plot, piece or parcel of land with the buildings and improvements thereon erected, situate, lying and being at Sandy Beach, in the Village of G-reenport, Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point on the northerly line of a 'certain right of way (being the right of way hereinbefore described in Parcel "A'), which point is the northeasterly comer of other lands formerly of the said Stewart (Parcel "A" herein); RUNNING THENCE northerly at right angles to the northerly line of said right of way 100 feet; THENCE westerly and at right angles to the last mentioned line 37.28 feet more or less to lands formerly of Herbert Fordham; THENCE southerly along the lands last mentioned to the northerly line of the aforesaid right of way; THENCE easterly along the northerly line of said right of way 37.28 feet to the point or place of BEGINNING. : SAID PREMSES includes lands now or formerly under the water of Sterling Creek adjacent thereto. PARCEL C: ALL that certain plot, piece or parcel of land,, with the buildings and improvements thereon erected, being a part of the land and premises owned by Sandy Beach Association of Greenport, N.Y., Inc., and situate, lying and being in the Villase of Greenport, Town of Southold, in the County of Suffolk and State of New York, and which said lot hereby conveyed is more particularly bounded and described as follows: BEGINNING at the northeasterly comer ofth~ premises hereby conveyed on the northerly line of a right of way hereinafter mentioned and defined, which line is also the southerly line of land formerly of Herbert Fordham, and at a stake set in said comer, which stake is distance 830.18 feet westerly on a course of north 68 degrees 53 minutes 20 seconds west from a locust post set in the westerly line of land of Inez Fordham, and running from said point of beginning westerly along the said northerly line of said right of way north 68 degrees 53 nfinutes 20 seconds west 30 feet to another stake in the northwesterly comer of the lot herein described and the northeasterly comer of another lot of land formerly owned by Sandy Beach Association of Crreenport, and formerly owned by Margaret B. Stewart; RUNNING thence southerly along the easterly line of said last mentioned land on a course of south 20 degrees 6 minutes 40 seconds west 100.30 feet more or less, to a point in the southerly line of land granted by The People of the State of New York to Sandy Beach Association of Greenport, N.Y., Inc., and which grant or patent is recorded in the office of the Secretary of State of the State of New York, and also recorded in the office of the Clerk of Suffolk county, N.Y., and which point is the southwesterly comer 'of the premises herein described, and the southeasterly comer of said land of Sandy Beach Association of Greenport, N.Y., Inc.; RUNNING THENCE in an easterly direction and along the southerly line of said grant or patent on a course of south 66 degrees 23 minutes 10 seconds east a distance of 30.03 feet to a point on said patent line distant 871.02 feet westerly measured along the same from the southeasterly corner of said grant or patent, and being the southeasterly corner of the lot herein described and the southwesterly corner of a lot of land now or formerly of Stoofho~ RUNNING THENCE in a northerly direction and along the westerly line of said lot of land now or formerly of Stoofhoffon a course of north 21 degrees 6 minutes 40 seconds east 101.62 feet to the northeasterly comer of the lot herein described and the northwesterly corner of said lot now or formerly of Stoothoff on the northerly line of said right of way at the point or place of BEGINNING. The above mentioned bearings are according to the true north meridian. TOGETHER with the riparian fights in Greenport Harbor in front of and abutting the premises hereby conveyed. SUBJECT, however, to easements by way of right of way over and upon the northerly 30 feet of the premises herein conveyed; and TOGETHER with easements by way of right of way over other portions of the right of way which embraces the northerly 30 feet of the premises of Sandy Beach Association of Greenport, N.Y., Inc. between the lands of Inez Fordham on the east thereof and the lands formerly of Herbert Fordham on the west thereof. ALSO, together with a right of way, in common with others, upon, over and across a parcel of land adjoining said last above mentioned right of way on the north thereof, arid which parcel of land is referred to as Parcel "C" in the interlocutory judgment of 1929 in the partition action in the County Court, Suffolk county, entitled Archibald N. Young, plaintiff against Nettie E. Hall and others, defendants, which said last mentioned right of way extends north to Manhanset Avenue. These premises herein granted are conveyed subject to any and all easements and restrictions contained in former deeds and agreements ofreeord. PARCEL D: ALL that certain plot piece of parcel of land, with the buildin, gs and improvements thereon erected, being a part of the land and premised owned by Sandy Beach Association of G-reenport, N.Y., Inc., and situate, lying and being in the Village of Greenport, Town of Southold, in the County of Suffolk and State of New York, and which said lot hereby conveyed is more particularly bounded and described as follows: BEGINNING at a point on the northerly line of a certain right of way (being the right of way hereinabove described in Parcel #1), which point is the northwesterly comer of lands now or formerly of George W. Stewart (Parcel #I herein); RUNNING THENCE northerly at right angles to the northerly line of said right of way 100 feet; THENCE easterly and at right angles to the last mentioned line 30 feet; THENCE southerly and at right angles to the last mentioned line, 100 feet to the northerly line of said fight of way; · THENCE westerly along the northerly line of said right of way, 30 feet to the point or place of BEGINNING. SAID PREMISES includes lands now or formerly under the waters of Sterling Creek adjacent thereto. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed, dated October 19, 2000, heretofore filed with the Suffolk County Clerk. RESERVING, HOWEVER, a legaI life estate~in the above-described premises with the buildings and improvements thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as they may choose, to change their remainderman as follows: TO or among any one or more members cfa class consisting of thc party of the party of the first part's descendants, in any degree, whether presently living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during her lifetime by properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint themselves, their estate, their creditors or the creditors of their estate, under any circumstances. TOGETHER with ail right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof} TOGETI-IER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fi~nd to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
