party of the first part, and
ROBERT J. HEANEY, residing at 4545 Route 25, Greenport, New York
JOAN L. DINIZIO, residing at 39 Sound Road, Greenport, New York

WITNESSETH, that the party of the first part, in consideration ofTen Dollars and oth. er valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected,
situate, lying and being near the Village of Greenport, Town of Southold, County of Suffolk
and State of New York, being on the north side of Corwin Street and known as lots numbered
40, 41, and 42 on "Plan of the S. Buel Corwin Estate, Greenport, Suffolk County, New York,
as laid out in lots in 1882, surveyed June 1904 for Referee's Sale, July 2, 1904, C.H.
Bateman, Surveyor and Engineer, Shelter Island, New York", filed in the office of the Clerk
of Suffolk County, said lots 40, 41, and 42 being bounded and described as follows:
Northerly by lots 37, 38 and 39, 147 feet;
Easterly by lot 43, 125.8 feet;
Southerly by Corwin Street, 146 feet;
Westerly by Eighth Street, 124.9 feet, be the said dimensions, more or less.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated May 3, 1965, and recorded in the Suffolk County Clerk's Office on May 7, 1965,
in Liber 5741 page 580.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected, in and to the party of the first part.
THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF
APPOINTMENT, exercisable as often as she may choose, to change her remainderman as
follows:
TO or among any one or more members of a class consisting of the party of the first part's
descendants, in any degree, whether presently living or born hereafter, in such proportions and
amounts, without regard to equality, outright or in trust, as the party of the first part may
direct and appoint during their lifetime by a properly written and acknowledged instrument,
and recorded prior to 'death, making specific reference to this power of. appointment. The
party of the first part may not appoint herself, her estate, her creditors or the credi.tors of her
estate, under.any circumstances.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party Of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party .of the first part has not done or suffered
anything whel-eby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the
party of the first part will receive the consideration for this conveyance and will hold thh fight to
receive such consideration as a trust fund to be applied first for the purpose of paying the cost of
the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
