BEING AND INTENDED TO BE the same piemises conveyed to the party of the first part by deed from Charles Malinauskas dated November 24, 1978, and recorded in the Suffolk County Clerk's Office on December 7, 1978, in Liber 8545 page 427. RESERVING, HOWEVER, a legal life estate in the above-described premises with the buildings and improvements thereon erected, in and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as they may choose, to change their remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descendants, in any degree, whether presently living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during their lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first part may not appoint themselves, their estates, their creditors or the creditors of their estate, under any circumstances. THIS DEED IS MADE AS AN EXEROISE OF THE SPECIAL POWERS OF APPOINTMENT AS SET FORTH IN A CERTAIN DEED DATED MARCH 9, 1998, RECORDED IN THE SUFFOLK COUNTY CLERK'S OFFICE IN LIBER 11883 PAGE 917 TO CHANGE THE REMAINDERMAN FROM SUSAN M. MALINAUSKAS TO SUSAN M. MALINAUSKAS AND MARY ANN BOKEN. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, Pxcept as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the Name for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
