THIS INDENTURE, made the 7th day of February, Two Thousand Twelve
BETWEEN
MARILYN WEIGOLD, residing at 1640 Chablis Path, Southold, New York 11971,
party of the first part, and
PETER J. CASTIGLIONE and CHERYLYNN A. CASTIGLIONE, husband and wife, residing
at 2500 Peconic Lane, Peconic, New York 11958,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Southold, County of Suffolk, and State of New York, known
and designated as Lot 9 on a map entitled "Map of Chardonnay Woods at Southold," filed on
September 28, 1989 as Map No. 8822 in the Office of the Clerk of the County of Suffolk, being
more fully bounded and described as follows:
BEGINNING at a point on the westerly side of Chablis Path distant 979.69 feet southerly from
the southerly end of a curve connecting the westerly side of Chablis Path and the southerly side
of Burgundy Court; said curve having a radius of 20 feet a length of 31.42 feet;
RUNNING THENCE along the westerly side of Chablis Path as it curves, the following three (3)
courses and distances:
1. Along the arc of a curve bearing to the right having a radius of 125 feet a length of 143.51 feet;
2. Still along the arc of a curve bearing to the right having a radius of 25 feet a length of 27.37
feet to a point of reverse curve;
3. Along the arc of a curve bearing to the left having a radius of 50 feet a length of 70.90 feet to
the division line of Lot 8 and Lot 9 on the aforesaid map;
RUNNING THENCE along said division line the following two (2) courses and distances:
1. North 45 degrees 44 minutes 44 seconds West, 50 feet;
2. North 85 degrees 19 minutes 50 seconds West, 100 feet;
RUNNING THENCE North 00 degrees 50 minutes 30 seconds West, 133.11 feet;
RUNNING THENCE along an open space area the following three (3) courses and distances:
1. North 89 degrees 09 minutes 30 seconds East, 184.54 feet;
2. South 45 degrees 44 minutes 44 seconds East, 85.76 feet;
3. North 86 degrees 59 minutes 30 seconds East, 50 feet to the westerly side of Chablis Path, the
point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by
deed dated January 3, 1995, and recorded January 13, 1995, in the Office of the Suffolk County
Clerk in Liber 11710, Page 681.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part, the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of tiffs indenture so
requires.
