Present Were: Absent were: Jack McGreevy, Member Doug Hardy, Member Audrey Horton, Member Derek Bossen, Member William McDermott, Member Lauren Standish, Secretary Scott Russell, Supervisor Peter Young, Chairman John Bredemeyer, Trustee CALL TO ORDER The meeting was called to order at 4:45 PM by Acting-Chairman Derek Bossen. OLD BUSINESS Member Jack McGreevy attended the Trustee meeting on Wed., January 18th. He was pleased to see the Board appreciated the CAC's comments. NEW BUSINESS Member Doug Hardy suggested the council members take a look at the massive boulders at the end of Town Beach. He was concerned about a possible private property issue. Supervisor Russell explained that there was an easement against all the private property owners, which was necessary to shore up the road. 2 Supervisor Russell discussed the role of the CAC for the new year. He shared the Town Board's thoughts on transferring the CAC members to other committees because they felt there was too much redundancy. Member Jack McGreevy was adamantly opposed. He felt that the CAC has become more focused and stronger as a group as protectors of the natural resources of the Town. Supervisor Russell made it clear that he was in favor of the CAC and that compensation was not an issue, however, was asked by the Town Board members to share their ideas with the CAC. Supervisor Russell suggested inter-committee relationships. The CAC members were in favor of working with the other Town committees. APPROVAL OF MINUTES Moved by William McDermott, seconded by Doug Hardy, to Approve the Minutes of January 11, 2012. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by Audrey Horton, seconded by Derek Bossen, it was RESOLVED to SUPPORT the Wetland Permit and Coastal Erosion Permit applications of GREG KARAS to construct a rock revetment with two courses of boulders to match existing size and shape of adjacent property to the east; lower course 4-5 ton, upper course 2-3 ton, and 8' wide at toe of existing bluff. Located: 135 Sound View Rd., Orient. SCTM#15-3-3 Inspected by: Audrey Horton The CAC Supports the applications with the Condition the non-turf buffer is increased to a total of Vote of Council: Ayes: All Motion Carried Moved by Audrey Horton, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of MADELINE SCHLAEFER to remove existing ladder; remove sufficient portion of existing wood walkway to allow removal of 47' of existing bulkhead; construct 47' of new bulkhead in-place; re-install existing ladder; and replace removed walkway in-place as needed. Vote of Council: Ayes: All Motion Carried Moved by Audrey Horton, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of DEBRA LACHANCE to construct/rebuild existing steps to water in-kind; replace existing deck at top of stairs with new 30 sf. deck; and trim vegetation within new step area. Located: 630 Ruch Lane, Greenpod. SCTM#52-2-26 Inspected by: Audrey Horton The CAC Supports the application with the Condition of a 10' non-turf buffer and a drainage plan for the existing dwelling. Vote of Council: Ayes: All Motion Carried ROBERT NELSON to construct a 12'X 21'-3" wood frame deck with steps onto the seaward side of the existing dwelling. Located: 2955 Bayshore Rd., Greenpod. SCTM#53-6-5 Inspected by: Audrey Horton The CAC could not make a recommendation because the project was not staked as of February 15th. Moved by Derek Bossen, seconded by William McDermott, it was RESOLVED to SUPPORT the Wetland Permit application of JOSEPH & HEIDI BATTAGLIA to construct a 4'X 68' fixed dock elevated a minimum of 4' above grade; install a 3'X 15' seasonal ramp; and a 6'X 20' seasonal floating dock. Located: 2100 Hobart Rd., Southold. SCTM#64-3-3.2 Inspected by: William McDermott The CAC Suppods the application with the Condition the application is within the bounds of all Town Codes. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of PETER & MARY KORNMAN to demolish the existing garage to allow for proper footings and foundation to use exact footprint to create additional two-story living space; replace windows throughout existing dwelling; and construct new front entry addition. Located: 1077 Bay Home Rd., Southold. SCTM#56-5-39 Inspected by: William McDermott The CAC Supports the application, however, observed a discharge hose on the edge of the bank. Vote of Council: Ayes: All Motion Carried JOHN & DANIELLA VENETIS to construct a second-story addition to the existing dwelling; construct a trellis over rear deck; construct alterations to the existing dwelling; change windows and siding; remove pad of deck in front; and repair/replace sanitary system in front yard, if required. 4 Located: 2600 Takaposha Rd., Southold. SCTM#87-6-4 The CAC did make an inspection, therefore no recommendation was made. Moved by Jack McGreevy, seconded by William McDermott, it was RESOLVED to SUPPORT the Wetland Permit application of ALICE MIGNEREY to repair the existing steps and landings down to beach, replace handrails and piles. Located: 1480 Paradise Point Rd., Southold. SCTM#81-3-21 Inspected by: Jack McGreevy, William McDermott The CAC Supports the application with the Condition of a drainage plan to address the erosion problem in the Iow spot near the top of the stairs. Vote of Council: Ayes: All Motion Carried Moved by Jack McGreevy, seconded by William McDermott, it was RESOLVED to SUPPORT the Wetland Permit application of JOHN REARDON to reconstruct 200' of storm-damaged bulkhead using vinyl sheathing, increasing height by 1'+/- with stairs to grade on seaward side; replace 184' of storm-damaged concrete retaining wall, with stairs from upland grade and 5' returns at each end, with 200' of retaining wall, using vinyl sheathing, with stairs from upland grade and 8' returns at each end; construct new deck 10'X 20' between bulkhead and retaining wall; and fill area between bulkhead and retaining wall with clean sandy soil from upland location, approx. 350 cy. Located: 920 Cedar Point Drive East, Southold. SCTM#90-2-19 Inspected by: William McDermott, Jack McGreevy The CAC Supports the application, however, there is a serious run-off problem coming off of the dwelling and down the bluff and a pipe coming out of the bluff. The CAC recommends a 10' non- turf buffer and the new section of the retaining wall is extended to the property line with a return on the west end and the bulkhead is connected to the adjacent bulkheads. Vote of Council: Ayes: All Motion Carried Moved by William McDermott, seconded by Derek Bossen, it was RESOLVED to SUPPORT the Wetland Permit application of PATRICIA TERRY to construct approx. 47 If. of vinyl bulkhead in place of existing timber bulkhead and backfill and renourish storm scour with approx. 40 cy. of sandy fill to be trucked in from an upland source and planted with native vegetation to restore vegetated slope behind bulkhead. Located: 400 West Lake Dr., Southold. SCTM#90-1-22 Inspected by: Jack McGreevy, William McDermott The CAC Supports the application with the Condition of a 10' non-turf buffer; the stormwater run- off is retained on the property; and the western return is at least 10' deep or connected to the adjoining bulkhead. Located: 500 West Lake Dr., Southold. SCTM#90-1-23 Inspected by: Jack McGreevy, William McDermott The CAC Supports the application with the Condition of a 10' non-turf buffer and the bulkhead is connected to the adjoining bulkhead or to the return. Vote of Council: Ayes: All Motion Carried SEVEN CATS INVESTMENTS LLC to construct a single-family dwelling, driveway and sanitary system. Located: 2870 Henry's Lane, Peconic. SCTM#74-1-1 The CAC could not make a recommendation because the project was not staked as of February 14% Moved by Doug Hardy, seconded by William McDermott, it was RESOLVED to NOT SUPPORT the Wetland Permit application of EUGENE BURGER (WEST COVE, LLC) to construct a 4'X 123' fixed elevated catwalk, 3'X 15' hinged ramp and a 6'X 20' floating dock attached to the existing bulkhead; and legalize the existing 12'X 21' platform; legalize and reconstruct the existing landing 4'X 5' and stairs 4'X 6' all located along the seaward side of the bulkhead. Located: 1050 West Cove Rd., Cutchogue. SCTM#111-5-1 Inspected by: Derek Bossen, Doug Hardy The CAC does Not Support the application and recommends a mooring. A dock of this size and length would interfere with lateral shoreline navigation and small craft navigation especially in windy conditions and because of the functional obsolescence of docks in this area. Vote of Council: Ayes: All Motion Carried Moved by Derek Bossen, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of LAWRENCE NIEBLING to construct a 4'X 70' timber walkway over an existing deteriorating concrete walkway leading to a proposed 6'X 10' open grate platform with 4'X 15' stairs proposed for beach access; existing stairs with the portion of the concrete walkway to be removed; install 100+/- If. of 18-24" stone (500-1000 lb.) on filter fabric along the eroded scarp at the toe of the existing bluff; 50+/- cy. of clean sand from an upland source is proposed to cover the stones and restore the bluff slope and planted with beach 6 grass on 12" centers; and all bare areas on the bluff face to be planted with Beach Grass on 12" centers. SCTM#119-1-18 inspected by: Derek Bossen, Doug Hardy Vote of Council: Ayes: All Motion Carried Moved by Derek Bossen, seconded by Doug Hardy, it was RESOLVED to SUPPORT the Wetland Permit application of JAMES LUHRS to construct a 3'X 20' ramp up onto a 3'X 70' fixed catwalk with a 3'X 16' seasonal aluminum ramp onto a 6'X 20' seasonal floating dock secured by two 8" dia. anchor pilings. Located: 1455 Bay Ave., Mattituck. SCTM#143-5-5 inspected by: Derek Bossen, Doug Hardy Vote of Council: Ayes: All Motion Carried Moved by Doug Hardy, seconded by Derek Bossen, it was RESOLVED to SUPPORT the Wetland Permit application of JOHN & AMELIA WOOD to replace a wooden bulkhead with navy style timber bulkhead installed adjacent and inland of existing bulkhead; remove old bulkhead by cutting pilings at or near grade, preserving existing wetland substrate; remove and replace existing brick walkway on sand bed and leveling as needed. Located: 3150 Ole Jule Lane, Mattituck. SCTM#122-4-19 Inspected by: Derek Bossen, Doug Hardy The CAC Supports the application with the Condition of a 10' non-turf buffer. Vote of Council: Ayes: All Motion Carried Moved by Derek Bossen, seconded by Jack McGreevy, it was RESOLVED to SUPPORT the Wetland Permit application of HESS LIFETIME ClTIP TRUST to remove and replace in-kind, in-place and 8" higher approx. 89 If. of timber retaining wall; backfill with approx. 15 cy. of sandy fill; and replant with native vegetation approx. 15' wide embankment to be maintained as a 15' wide non-turf buffer. Located: 6242 Peconic Bay Blvd., Laurel. SCTM#128-2-4 inspected by: Derek Bossen, Doug Hardy The CAC Supports the application with the Condition the backfilled area is planted with native vegetation; the three (3) cedar trees at the top of the bluff are maintained; and the non-functional groin is removed. Vote of Council: Ayes: All Motion Carried HAY HARBOR CLUB to conduct maintenance dredging, 25 cy. of sand from the diving area for upland disposal at the beach, on site. Located: Fox Ave., Fishers Island. SCTM#9-3-1 The CAC did not make an inspection, therefore no recommendation was made. DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND & COASTAL EROSION PERMITS Moved by Audrey Horton, seconded by Derek Bossen, it was RESOLVED to SUPPORT the application of ROBERT & LAUREN EICHER to Amend Wetland Permit #5467 to install five (5) new bulkhead face pilings adjacent to the existing face pilings. Located: 1555 Shore Rd., Greenport. SCTM#47-2-29 Inspected by: Audrey Horton The CAC Supports the application with the Condition of a 10' non-turf buffer. The CAC questions the legality of the deck and wire fence. Vote of Council: Ayes: All Motion Carried Moved by Derek Bossen, seconded by Jack McGreevy, it was RESOLVED to NOT SUPPORT the application of JAMES ORIOLI & SUSAN MAGG to Amend Wetland Permit #4559 for the as-built 130' catwalk with extended walkway; a proposed 3'X 6' ramp; a 6'X 30' floating dock with two (2) 6" dia. pilings to secure dock; and one (1) seasonally removed 8'X 18' jet-ski floating dock. Located: 495 Halls Creek Dr., Mattituck. SCTM#116-7-4 Inspected by: Derek Bossen, Doug Hardy The CAC does Not Support the application because the dock and floats do not conform to the Town Code. Vote of Council: Ayes: All Motion Carried Moved by Derek Bossen, seconded by Doug Hardy, it was RESOLVED to SUPPORT the application of JAMES ORIOLI & SUSAN MAGG to Amend Wetland Permit #6352 to include the as-built 20'X 40' in-ground swimming pool and drywell for pool backwash; 10'X 10' open pergola; 4'X 16' walkway; plant four (4) 6" wide oak trees; and re- vegetate non-disturbance buffer as required. Located: 495 Halls Creek Dr., Mattituck. SCTM#116-7-4 Inspected by Derek Bossen, Doug Hardy The CAC Supports the application with the Condition the disturbed area is vegetated with native vegetation and there is a 20' non-turf buffer landward of the 8' berm and planted with native vegetation. Vote of Council: Ayes: All Motion Carried Moved by Derek Bossen, seconded by Doug Hardy, it was RESOLVED to SUPPORT the application of KEVlN LATULIP to Amend Wetland Permit #7677 to construct 3'X 8'8" steps with hand-rails from the top of the bulkhead to the beach grade level. Located: 5386 Peconic Bay B~vd., Laurel. SCTM#128-2-13 Inspected by: Derek Bossen, Doug Hardy Vote of Council: Ayes: All Motion Carried LEONARD ORR to Amend Wetland Permit #7315 and Coastal Erosion Permit #7315C to remove 255 If. of concrete seawall and construct 255 If. of new reinforced, cast-in-place concrete seawall with new reinforced, cast-in-place concrete footing, 275 cy. over 2,750 sf. and establish a 10' wide non-turf buffer landward of the new seawall all at and landward of the high tide line; place 35 cy., 80 tons of stone shoreline protection along the face of the new wall water of the apparent high tide line and landward of mean high water. Located: Private Rd. off Equestrian Ave., Fishers Island. SCTM#4-7-14 The CAC did not make an inspection, therefore no recommendation was made. Member Derek Bossen will attend the next regular meeting of the Board of Trustees scheduled for Wed., February 22, 2012. The next meeting of the Conservation Advisory Council has been set for Wed., March 14, 2012 at 4:30 PM at Down's Farm Preserve.
