each as to an undivided one-third interest, as joints
tenants with right of survivorship

successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being lecdw at Greenport, in the Town of Southold, County of Suffolk and
State of New York, known and designated as and by Lot No. 12, as shown on a
certain map entitled, "Map of Homestead Acres at Greenport", filed in the Office
of the Clerk of the County of Suffolk on July 17, 1986, as Map No. 8150, being
bounded and described as follows:
BEGINNING at a point on the Westerly side of Willow Drive (Private Road) distant
453.51 feet as measured westerly aling the southerly side of Inlet Pond Road and
southerly along the westerly side of Willow Drive (Private Road) from the corner
formed by the intersection of the westerly side of Westwood Lane with the northerly
side of Inlet Pond Road; said point also being where the division line between Lot
12 and Lot 13 on said map intersects the westerly side of Willow Drive;
RUNNING THENCE along the westerly side of Willow Drive (Private Road), South 02
TAX MAP degrees 17 minutes 10 seconds West, 125.00 feet to the division line between Lot 11
DESIGNATION and Lot 12 on the aforesaid map;
D,,t. 1000 THENCE North 87 degrees 42 minutes 50 seconds West, along said last mentioned
Ser. 033.00 division line, 200.00 feet to land now or formerly of Morrison;
BIL. 06.00 THENCE along said land now or formerly of Morrison the following two courses and
distances: (1) North 02 degrees 17 minutes 10 seconds East, 24.28 feet; (2) North
Lol(s) 01 degrees 42 minutes 50 seconds East 100.73 feet;
005.000 THENCE South 87 degrees 42 minutes 50 seconds East, 201.01 feet along the division
line between Lot 12 and 13 on the aforesaid map to the westerly side of Willow Drive
(Private Road) at the point or place of BEGINNING.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first
part by deed from SCHEMBRI HOMES, INC. dated October 24, 1997 and recorded in the
Suffolk County Clerk's Office in Liber 11860 cp 612 on November 5, 1997.
RESERVING, HOWEVER, a legal life estate in the above-described premises with the
buildings and improvements thereon erected in and to the party of the first part,
MARY T. GELLER, solely for the use and occupancy of said party of the first part.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
