THIS INDENTURE, made the 20th day of April, nineteen hundred and ninety-nine, BETWEEN Enzo Cippitelli and Agnes Cippitelli, 605 Green Lake Road, Catskill, New York 12414, party of the first part, and Agnes Cippitelli and Enzo Cippitelli, 605 Green Lake Road, Catskill, New York 12414, as Trustee of The Agnes Cippitelli Living Trust, dated 4/20/99, party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and no/100 ($10.00), lawful money of the United States, to them paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs, successors or assigns of the party of the second part forever, ALL that certain lot, piece or parcel of land together with the buildings and improvements located and to be erected thereon, situate, lying and being at Arshamomoque, Town of Southold, County of Suffolk and State of New York, more particularly bounded and described as follows: See Schedule.A annexed. BEING the same premises conveyed by Howard F. Harris, Grantor, to Enzo Cippitelli and Agnes Cippitelli, Grantee, by Deed dated January 30, 1998 and recorded in the Suffolk County Clerk's Office on February 5, 1998 in Liber 11876 of Deeds at page 886. THE GRANTOR named herein is the sole beneficiary of the Grantee, The Agnes Cippitelli Living Trust, dated 4/20/99, during the lifetime(s) of the Grantor and is entitled to veterans and senior exemptions as provided under RPTL subsections 458(7), 458-a(5) and 467(9). _ SUBJECT to covenants, conditions, restrictions and rights of way of record, if 2ny. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been incumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost;of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
