POOLE, residing at 208 Monsell Place, Greenport,New York 11944 party of the first part, and F ", (^-- --- •— ADELE DeLUCA f/n/a ADELEBRIN residing at 9523 NW 38h Place, Sunrise, Florida 33351 party of the second part, WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, her undivided one-half interest in and to ALL THAT CERTAIN plot, piece or parcel of land, with the buildings thereon erected, situate, lying and being in the Village of Greenport, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows:- BEGINNING at a point on the northerly side of Monsell Place, distant westerly along said line 110 feet from the point formed by the intersection of the said line with the westerly side of Atlantic Avenue; RUNNING THENCE along the northerly side of Monsell Place, South 72 degrees 26 minutes 20 seconds West, 55 feet to a concrete monument; RUNNING THENCE North 17 degrees 32 minutes 20 seconds West, 98.61 feet to a point marking the southwesterly corner of land on the southwesterly corner of land of Matthias; RUNNING THENCE along the southerly side of land of Matthias, North 73 degrees 06 minutes 40 seconds East, 55 feet to a point marking the southwesterly corner of land of Corwin; RUNNING THENCE along land now or formerly of William Rodman Pell and Lillian Pell, South 17 degrees 32 minutes 30 seconds East, 97.96 feet to the point or place of BEGINNING. BEING AND INTENDED TO BE the same premises conveyed to the party of the first part and Adele Brin by deed from Lyle Wester and Catherine Wester, his wife, dated June 17, f R1 1982, and recorded in the Suffolk County Clerk's Office on July 22, 1982, in Liber 9214 page 504. RESERVING,• HOWEVER, a legal life estAte in the above-described premises with the buildings and improvements thereon erected, A and to the party of the first part. THE PARTY OF THE FIRST PART HEREBY RESERVES A SPECIAL POWER OF APPOINTMENT, exercisable as often as she may choose, to change her remainderman as follows: TO or among any one or more members of a class consisting of the party of the first part's descendants, in any degree, whether presently living or born hereafter, in such proportions and amounts, without regard to equality, outright or in trust, as the party of the first part may direct and appoint during her lifetime by a properly written and acknowledged instrument, and recorded prior to death, making specific reference to this power of appointment. The party of the first pat may not appoint herself, her estate, her creditors or the creditors of her estate, under any circumstances. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof, TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
