a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF FEBRUARY 3, 2005

Property Location: 555 Village Lane, Orient

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicants' 14,436 sq. ft. parcel has 152.86 feet along
Village Lane and 94.35 feet along the northerly side. The property is improved with a single-family,
two-story frame house with deck and accessory (one-story and 2-story) frame barn, as shown on the
10/20/2004 survey prepared by John C. Ehlers, L.S.
BASIS OF APPLICATION: Building Department's November 12, 2004 Notice of Disapproval, citing
Sections 100-242A and 100-244, in its denial of a building permit to construct a proposed addition
enclosing deck which is less than 10 feet from a single side yard.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on January 20, 2004 at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants wish to enclose a 14' x 16'4" section of
the existing deck, which new construction is located within the nonconforming side yard at less than
the code required minimum of 10 feet.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. The existing deck is six (6) feet from the side line
instead of the code required 10 feet, resulting in nonconformance of the four linear feet. The
existing 25 ft. rear setback of the deck will remain unchanged. It is only this side yard section of the

deck within 10 feet of the property line that requires a variance, and the purpose is to build an one-
story, unheated porch.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance, it is common for homeowners to place a porch at
the rear of the dwelling, and the applicants have chosen use of an existing rear deck for this
purpose.
3. The variance granted herein is substantial. The code requires a minimum of 10 feet on a single
side yard, and the porch enclosure utilizes an existing deck, resulting in a nonconformance of
approximately 65 sq. ft. of porch area (4' extending within the side yard restriction).
4. No evidence has been submitted to suggest that a variance in this residential community will
have an adverse impact on the physical or environmental conditions in the neighborhood.
5. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of enclosing the deck for a new porch, while preserving and protecting
the character of the neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Chairwoman Oliva, seconded by
Member Orlando, and duly carried, to
GRANT the variance as applied for, as shown on the 11/3/04 plan prepared by James
Garretson, A.I.A. and within the proposed setbacks of the existing deck shown on the
10/20/2004 survey prepared by John C. Ehlers, L.S., SUBJECT TO THE CONDITION that
the porch enclosure remain as a seasonal enclosure, not to be converted as heating living
space.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are
expressly addressed in this action.

GENERAL CONSTRUCTION NOTES ~ ~
1. The information on this set of construction documents is to relate basic design
~ntent and framing details. They are intended as a construction aid, not a substitute
for generslly accepted good building practice and compliance with current New York
state building codes. The general contractor is responsible for providing standard
construction details and procedures to ensure a professionally finished, structurally
sound, and weatherproof completed product.
2. General Contractor to coordinate all sub contractors, scheduling of won~, and
interaction~between trades.
3. The general contractor is responsible for ensudng that all work and construction
meets or exceeds current federal, state, and local Codes, ordinances and regulations,
etc. These codes are to be considered as part ofthe specifications for thls building
and should be adhered to even if they are in variance with the plan.
4. Dimensions shall take precedent over scale drawings (do not scale drawings).
5. The designer h~s not been engaged for construction supervisi°n and assumes no
responsibility for construction coordinating with these plans, nor responsibility for
construction means, methods, techniques, sequences, or procedures, or for safety
precautions and programs in connection with the work. There ara no warranties for a
specific use expressed or implied in the use of these plans.
$. Refer to floor plans, exterior elevations, and window schedule for types and size~ of
windows. All windows to be Andersen high p~rformance quali~j or approved equal.
7. Door and window headers to align unless otherwise noted.
8. General contractor is to ensure that masonry
construction meets or exceeds all manufacturer's speci~cations and ~pplicable codes.
GENERAL FOUNDATION NOTES
1. General contractor to review plans, elevations, and details to determine intended
heights of finished floor(s) above typical grade.
2. All footings to rest on undisturbed soil,
3. Provide ~" expansion joint matedal between all concrete slabs and abutting
concrete or masonry walls occurring In exterior or unheated interior areas.
4. Unless otherwise noted, all slabs on grade to be 2500 psi. Concrete on 4" sand or
gravel fill minimum, with 6x6 - 10/10 wire mesh rethfoming. Intedor slabs to be placed
on 6 mil. stabilized polyethylene vapor barrier.
5. Provide crawl space ventilation per local code requirements.
6. General contractor to install cop-r~tex (or.copper) sheet metal termite shields
between all wood surfaces that are exposed to concrete or masom,j surfaces.
7. Dampproof extedor of foundation with a bituminous coating as per code and soil
conditions.
